La démocratie constitutionnelle affronte des défis nouveaux ou renouvelés (rôle de la « société civile », mondialisation, question religieuse). L’État lui-même est mis en cause et la question de son dépassement est posée, quand, par ailleurs, la vie politique des peuples paraît osciller entre la futilité (la « peopolisation ») et la fatalité (guerres, pauvreté, catastrophe écologique). Le droit constitutionnel est en cause. Le Droit exprime l’effort multimillénaire de maîtrise raisonnée de la vie sociale, et le droit constitutionnel son application au corps social, lui-même organisé dans un cadre territorial déterminé (l’État), doté d’un pouvoir qui en émane (la démocratie) et garantissant l’autonomie des membres du groupe (les droits et libertés). La première partie de cet ouvrage décrit la formation historique et intellectuelle de l’État, son universalisation et les conflits des diverses formes de la démocratie. La deuxième partie décrit le champ du droit constitutionnel : démotique (une terre, un peuple), politique (un pouvoir), civique (les libertés). La troisième partie pose la question, rarement abordée, des limites du droit constitutionnel, en particulier dans le contexte de la construction européenne. L’approche synthétique, sa dimension historique et comparatiste, son système de numérotation analytique feront de ce précis un instrument de travail précieux pour les étudiants et pour la préparation des concours administratifs. François Borella est professeur émérite (Université de Nancy). Il enseigne au premier cycle franco-allemand de Sciences Po à Nancy.
