A finales del siglo XVIII el pensador británico Jeremy Bentham planteó que la moralidad de los actos humanos debe juzgarse por su grado de utilidad . Así nació la doctrina del utilitarismo, que tiene como corolario la teoría de la justicia que sostiene que el interés común no es sino la suma de los intereses individuales. El utilitarismo, aunque muy influyente, no ha sido aceptado de manera unánime, entre otras razones por sus consecuencias anti-igualitarias. El filósofo norteamericano John Rawls se propuso formular una teoría alternativa de la justicia. En 1971 planteó que las reglas de convivencia que los seres humanos acordaran en una situación en la cual ellos pudieran desprenderse de sus intereses particulares serían justas. Una de esas reglas sería el principio de la diferencia , que sostiene que una política social no mejora el bienestar social si no mejora a quienes están peor en la sociedad. Esto implica una forma de igualitarismo social. Así se plantea un debate entre la izquierda igualitaria y la derecha utilitaria. Tradicionalmente, se ha creído que la discusión sobre la justicia pertenece al ámbito de la filosofía política y moral. Sin embargo, desde el año 1950, en la economía ha habido algunos progresos que tienen implicaciones sobre esa discusión. El propósito de este texto es mostrar esas implicaciones. Ellas conducen a una formulación muy precisa de la justicia, políticamente intermedia entre las ideas de Bentham y de Rawls. Este libro es un buen ejemplo de cómo la fertilización cruzada entre la filosofía y la economía produce un modo de pensar riguroso y distinto sobre una de las preguntas más apasionantes de las ciencias sociales: ¿qué es una sociedad justa? La respuesta que se da aquí es que una sociedad justa es una sociedad profundamente democrática, en la cual cada individuo tiene el mismo poder de definir el bien común.

Saldar esta deuda pendiente implica apartarse de la clásica distinción de la responsabilidad contractual y extracontractual heredada del Derecho Civil, para posicionarse a favor de la unidad de la responsabilidad patrimonial en el Derecho Administrativo. Tras el examen crítico sobre los fundamentos y requisitos de la responsabilidad pública, se presenta como posible y realizable la propuesta que años atrás fue concebida desde el ordenamiento jurídico colombiano, de interés para el estudio de la institución jurídica en otras latitudes.

Some 2.5 billion human beings live in severe poverty, deprived of such essentials as adequate nutrition, safe drinking water, basic sanitation, adequate shelter, literacy, and basic health care.
