Studienarbeit aus dem Jahr 2012 im Fachbereich Geschichte Europas - Mittelalter, Frühe Neuzeit, Note: 1.0, Universität Stuttgart (Historisches Institut), Veranstaltung: Die Habsburger im Mittelalter, Sprache: Deutsch, Abstract: Margarete Maultasch , die Tochter Herzog Heinrichs von Kärnten und Tirol war nach seinem Tod die Erbin des zur damaligen Zeit, von den Habsburgern, Wittelsbachern und Luxemburgern, sehr begehrten Paßlandes Tirol. Ihr Erbe machte sie zu einer sehr attraktiven Frau, unabhängig von ihrer in der Nachwelt sehr umstrittenen äußeren Erscheinung. Das Hauptaugenmerk dieser Arbeit soll auf einer Zeit liegen, in der Margarete bereits mit dem Luxemburger Johann Heinrich, Sohn König Johanns von Böhmen und Bruder des späteren römischen Kaisers Karls IV. verheiratet war. Diese Verbindung kam, wie die meisten zu dieser Zeit, bereits im Kindesalter zustande. Nun stellt sich die Frage, was Margarete Maultasch so besonders und auch in ihrer Zeit, so skandalös gemacht hat, so dass ihr ein eigener Artikel im LexMa gewidmet wird, eine Besonderheit, die selbst einigen Gemahlinnen der Kaiser nicht widerfuhr. Welchem Umstand verdient sie solch eine Ehre und solch ein Bestehen in der Geschichte? Es ist ihre berühmte und in vielen zeitgenössischen Quellen dokumentierte und erfasste Eheaffäre und ihre Scheidung von ihrem ersten Gemahl Heinrich, die auf ihre Initiative hin zustande gekommen ist. Auf die Verstoßung ihres 19-jährigen Mannes und die Scheidung folgte auch noch wenige Monate später ihre Neuvermählung mit Ludwig dem Bayern, die wiederum eine politisch motivierte Heirat war. So ist die Verstoßung und Scheidung auf die Initiative einer Frau hin und die kirchenwidrige Neuvermählung mit einem anderen Mann der Grund für so große Aufmerksamkeit, der ihrer Person entgegengebracht wird. Um diesen Skandal zu beleuchten und zu erklären, soll zunächst eine kurze Darstellung der Verhältnisse und Abläufe einer Scheidung gegeben werden und die Eheauffasung im Mittelalter skizziert werden, um im späteren Verlauf die Einzigartigkeit der Eheaffäre Margarete Maultaschs zeigen zu können. Zwei zeitgenössische Quellen, von den beiden Gelehrten Marsilius von Padua und Wilhelm von Ockham , sollen dabei behilflich sein, in diese Zeit zurückzuschauen. Dabei darf eine kurze Quellenkritik nicht fehlen, denn die meisten Quellen aus dem Mittelalter, wie zum Beispiel Chroniken, Urkunden oder kirchliche Gutachten, wurden bewusst für eine bestimmte Partei oder die Nachwelt verfasst und waren somit meist von Herrschern oder anderen Obrigkeiten motiviert und finanziert worden.
