In ten years 80 per cent of the legislation related to economics, maybe also to taxes and social aff airs, will be of Community origin.” This declaration has been largely quoted, paraphrased and deformed by different authors, creating a persistent myth according to which 80% of the legislative activity of the national legislatures would soon be reduced to the simple transposition of European norms”. This book addresses the topic of the scope and impact of Europeanization on national legislation, as a part of the Europeanization debate which raises normative concerns linked to the “democratic deficit” debate. The state of the art shows that there are many assumptions and claims on how European integration may affect national legislation and, more generally, domestic governance but that there is a lack of solid and comparative data to test them. The aim of the book is to give a solid and comparative insight into Europeanization focusing on effective outcomes in a systematic way. This book analyzes the period 1986-2008 and includes an introduction, a global overview of European legislative activities which set the background for Europeanization of national legislatures, 9 country contributions (8 EU member states + Switzerland) including systematic, comparative and standardized data, tables and figures, and a conclusion with a comparative analysis of the European and domestic reasons for Europeanization. All national contributions conclude that Europeanization of national legislation is much more limited than assumed in the literature and public debate. It is limited to 10 to 30% of laws (depending on the country), far less than the 80% predicted by Jacques Delors and mentioned daily by medias and public opinion leaders to demonstrate EU domination on member states. Beside that general statement, the various chapters propose a deep insight on EU constraint over national legislation, providing much information on the kind of laws and policies that are Europeanized, the evolution of this process through time, the impact of Europeanization on the balance of powers and the relations between majority and opposition at national level, the strategies developed by national institutions in that context, and many other issues, making the book of interest to academics and policy-makers concerned with Europeanization and national legislation.

This book i sone of two volumes in which leading scholars examine the way in which EU member states co-ordinate their European policies. Eschewing the 'Europeanisation' problematic within which the issue is usually adressed, this book adopts a broader, more inclusive approach. It examines domestic processes and investigates co-ordination in ten member states - Austria, Belgium, Denmark, France, Germany, Greece, Italy, Portugal, Spain and the United Kingdom - looking at co-ordinating ambitions, the actors involved in EU policy making, and the structures and processes by which policy is made. From a comparative perspective, the book identifies and assesses the impact of the influiences that have shaped systems of national co-ordination - the demands exerted by Union membership, the instituional structure of the national polity, the pre-existing balance between domestic institutions, administrative norms and values, and attitudes, both popular and elite, the European integration. It assesses the extent to which there has been a convergent response to the administrative challenges posed by membership on the part of the member states or whether a pattern of divergence emerges. The effectiveness of member states in influencing policy outcomes at the European level is also addressed. The companion volume answers similar questions about national administrations in Brussels. Looking at twelve member states, it is the first systematic examination of the role played by Permanent Representations in national EU policy making.

The use of so-called "new" environmental policy instruments such as eco-taxes, tradable permits, voluntary agreements and eco-labels has prompted widespread claims that these devices have replaced regulation. These papers offer a fresh perspective on the evolving tool-box of environmental policy.

European integration has profoundly changed the relationship between national and subnational governments and has led to the emergence of the Europe of the Regions. This edited volume highlights some of the problems involved in the integration of the three main levels of governance in the European Union: the regional, national, and supranational level. The contributors address recent developments in various regions and examine the way these regions have adjusted to the growing importance of the European Union's multilevel governance system. Among the issues discussed are the emergence and institutionalization of new regional political systems, such as those of Scotland, Wales, and Flanders; the channels available to the regions for influencing the EU policy process in relation to their constituencies; and horizontal projects of integration among regions, which make the whole multilevel governance system more flexible as well as more complex.

The continuing development of the European Union (EU) is transforming policy and politics in its member countries, and possibly in an even larger number of potential members. This book offers a detailed investigation of the Europeanization of national environmental policy in ten western European countries since 1970. By blending state-of-the-art theories with fresh empirical material on the many manifestations of Europeanization, it sheds new light on the dynamics that are decisively reshaping national environmental policy. It also offers an original assessment of how far Europeanization has produced greater policy convergence in western Europe. Throughout, the approach taken is genuinely comparative, drawing on the insights provided by leading country specialists.

Comparative Politics is a series for students and teachers of political science that deals with contemporary issues in comparative government and politics. The General Editors are Max Kaase, Professor of Political Science, Vice President and Dean, School of Humanities and Social Science, International University Bremen, Germany; and Kenneth Newton, Professor of Comparative Politics, University of Southampton. The series is published in association with the European Consortium for Political Research. Today, parliamentarism is the most common form of democratic government. Yet knowledge of this regime type has been incomplete and often unsystematic. Delegation and Accountability in Parliamentary Democracies offers new conceptual clarity on the topic. This book argues that representative democracies can be understood as chains of delegation and accountability between citizens and politicians. Under parliamentary democracy, this chain of delegation is simple but also long and indirect. Principal-agent theory helps us to understand the perils of democratic delegation, which include the problems of adverse selection and moral hazard. Citizens in democratic states, therefore, need institutional mechanisms by which they can control their representatives. The most important such control mechanisms are on the one hand political parties and on the other external constraints such as courts, central banks, referendums, and supranational institutions such as those of the European Union. Traditionally, parliamentary democracies have relied heavily on political parties and presidential systems more on external constraints. This new empirical investigation includes all seventeen West European parliamentary democracies. These countries are compared in a series of cross-national tables and figures, and seventeen country chapters provide a wealth of information on four discrete stages in the delegation process: delegation from voters to parliamentary representatives, delegation from parliament to the prime minister and cabinet, delegation within the cabinet, and delegation from cabinet ministers to civil servants. Each chapter illustrates how political parties serve as bonding instruments which align incentives and permit citizen control of the policy process. This is complemented by a consideration of external constraints. The concluding chapters go on to consider how well the problems of delegation and accountability are solved in these countries. They show that political systems with cohesive and competitive parties and strong mechanisms of external constraint solve their democratic agency problems better than countries with weaker control mechanisms. But in many countries political parties are now weakening, and parliamentary systems face new democratic challenges. Delegation and Accountability in Parliamentary Democracies provides an unprecedented guide to contemporary European parliamentary democracies. As democratic governance is transformed at the dawn of the twenty-first century, it illustrates the important challenges faced by the parliamentary democracies of Western Europe.
