This book grows out of the work of a study group convened by the American Branch of the International Law Association. The group had a mandate to examine threats to the rules-based international order and possible responses. The several chapters in the book-all of which are written by distinguished international law scholars--generally support the conclusion that the rules-based international order confronts significant challenges, but it is not unraveling--at least, not yet. Climate change is the biggest wild card in trying to predict the future. If the world's major powers--especially the United States and China--cooperate with each other to combat climate change, then other threats to the rules-based order should be manageable. If the world's major powers fail to address the climate crisis by 2040 or 2050, the other threats addressed in this volume may come to be seen as trivial in comparison. The book consists of fourteen chapters, plus an introduction. Three chapters address specific threats to the rules-based international order: climate change, autonomous weapons, and cyber weapons. Eight chapters address particular substantive areas of international law: jus ad bellum, jus in bello, trade law, investment law, anti-bribery law, human rights law, international criminal law, and migration law. The remaining chapters provide a range of perspectives on the past evolution and likely future development of the rules-based international order as a whole.

In order to do so, the following steps will be taken: First, there will be an assessment of the two main legal provisions and their underlying ratio that are relevant for the practice of the CCAIL and their interplay, namely §1 CCAIL (providing genuine universal jurisdiction to German courts for International Crimes) and §153f CCP the prosecutorial discretion given in cases of pure foreign crimes traditionally frustrating §1 CCAIL.36 In a second step, cases that are exemplary for the previous approach will be examined on considerations made and reasons given by the FPG leading to decision to desist from proceeding and the restrictive ‘no-safe-haven’ practice – followed by an evaluation. In a third step, the current prosecutorial strategy – ‘structural investigations’ – and its theory as well as practice will be analysed to assess how the use of ‘structural investigations’ changes the evaluation of the reasons underlying the restrictive practice. The aim is to answer the research question: To what extent ‘structural investigations’ as the current German prosecutorial strategy used to investigate Crimes of International Law (in Syria) operate on the interplay between the prosecutorial discretion (§153f CCP) and the codified universal jurisdiction (§1 CCAIL) to be applied in a proactive – ‘global-enforcer’ – manner?

This study is the second in the four-part series entitled “Rethinking the Essentials of International Criminal Law and Transitional Justice”. While the first volume, The Concept of Universal Crimes in International Law, explored the parameters and theories related to crimes under international law, this book examines the notion of punishable participation in such crimes. It presents a general theory of personal criminal liability and provides a comprehensive overview of all forms of criminal participation in international law. The authors examine numerous primary materials in international and transnational criminal law, both historical and current, relating to both international and domestic jurisprudence. They also review academic literature that attempts to explain and bring consistency to the jurisprudence, as well as other sources such as reports of the International Law Commission. This rich empirical tapestry is then used to test and further develop an overarching conceptual theory and matrix that provides a better understanding of the boundaries of personal criminal liability lex lata and lex ferenda and of the relationship between the various forms of punishable participation in universal crimes. Like the first volume, this book makes a valuable contribution to a more coherent and practical understanding of international criminal law.
