"Boilerplate language in contracts tends to stick around long after its origins and purpose have been forgotten. Usually there are no serious repercussions, but sometimes it can cause unexpected problems. Such was the case with the obscure pari passu clause in cross-border sovereign debt contracts, when a Belgian court's novel judicial interpretation in Elliott Associates v. Peru rattled international finance by forcing a defaulting sovereign - for one of the first times in the market's centuries-long history - to repay its foreign creditors despite their refusal to enter into a restructuring agreement. Though neither party wanted this outcome, the vast majority of contracts subsequently issued demonstrate virtually no attempt to clarify the imprecise language of the clause. Using this case as a launching pad to explore the broader issue of 'stickiness' of contract boilerplate, Mitu Gulati and Robert E. Scott have sifted through more than one thousand sovereign debt contracts - dating back to the nineteenth century - and interviewed hundreds of practitioners to show that the problem actually lies in the nature of the modern corporate law firm. The financial pressure on large firms to maintain a high volume of transactions contributes to an array of problems that deter innovation and that are largely hidden from the individual lawyer tasked with drafting contracts. With the near certainty of massive sovereign debt structuring in Europe, The Three and a Half Minute Transaction speaks to critical issues facing the industry and has broader implications for contract design that will ensure it remains relevant to our understanding of legal practice long after the debt crisis has subsided"--Unedited summary from book jacket.

The Psychological Training Of The Marathon written by Gustavo Vaquera and has been published by Gustavo Vaquera this book supported file pdf, txt, epub, kindle and other format this book has been release on 2025-05-20 with Antiques & Collectibles categories.
The book addresses psychological preparation for the marathon, a dimension often overlooked in favor of running, physiological, nutritional, and biomechanical aspects. Although it is widely acknowledged that the mind plays a crucial role—especially in the last 12 kilometers—many runners and coaches lack a systematic method to develop it, relying instead on intuitive or motivational advice. The work debunks the myth that physical suffering automatically strengthens the mind and criticizes the lack of concrete tools in classical literature. It proposes a scientific approach, integrating Neuroscience, Psychoanalysis, Sport Psychology, and the experiences of professional athletes, to train skills such as resilience, pain management, focus, motivation, psychological endurance, anxiety control, and other mental factors that influence marathon performance. It includes a 16-week program with scientifically validated techniques (visualization, mindfulness, mental training journals, present-moment training, and others). It demonstrates that it is not enough to merely mention psychological aspects; it is essential to show how they can be trained.

This book designates Visualization Psychology as an interdisciplinary subject. The book contains literature reviews and experimental works that exemplify a range of open questions at this critical intersection. It also includes discourses that envision how the subject may be developed in the coming years and decades. The field of visualization is a rich playground for discovering new knowledge in both visualization and psychology. As visualization techniques augment human cognition, these techniques must be developed and improved by building on theoretical, empirical and methodological knowledge from psychology. At the same time, visualization processes surface numerous phenomena about interactions between the human mind and digital entities, such as data, visual imagery, algorithms, and computer-generated predictions and recommendations. Visualization psychology is a new type of science in the making.

The development of the Chronic Care Model (CCM) for the care of patients with chronic diseases has focused on the integration of taking charge of the patient and his family within primary care. The major critical issues in the implementation of the CCM principles are the non-application of the best practices, defined by EBM guidelines, the lack of care coordination and active follow-up of clinical outcomes, and by inadequately trained patients, who are unable to manage their illnesses. This book focuses on these points: the value of an integrated approach to some chronic conditions, the value of the care coordination across the continuum of the illness, the importance of an evidence-based management, and the enormous value of the patients involvement in the struggle against their conditions, without forgetting the essential role of the caregivers and the community when the diseases become profoundly disabling.
