A obra “A INCONSTITUCIONALIDADE DA TARIFAÇÃO DO DANO EXTRAPATRI-MONIAL NAS RELAÇÕES DE TRABALHO: reflexões jurídicas e filosóficas” se dedica à análise crítica da tarifação do dano extrapatrimonial na esfera trabalhista. A reforma trabalhista, promovida pela Lei nº 13.467/2017, incluiu o artigo 223-G, §1º, na CLT, tarifando os valores devidos em razão de danos extrapatrimoniais de acordo com o salário contratual do trabalhador ofendido: I) até três vezes o último salário contratual do ofendido em caso de ofensa de natureza leve; II) até cinco vezes o último salário contratual do ofendido em caso de ofensa de natureza média; III) até vinte vezes o último salário contratual do ofendido em caso de ofensa de natureza grave; e IV) até cinquenta vezes o último salário contratual do ofendido em caso de ofensa de natureza gravíssima. Tendo em vista o objetivo de analisar profundamente essa alteração legislativa promovida pela reforma trabalhista, a presente obra realiza uma análise filosófica e jurídica acerca da temática. A análise filosófica está centrada na concepção de Immanuel Kant sobre a dignidade humana e seus reflexos no mundo do trabalho, bem como no pensamento de Hannah Arendt a respeito da condição humana do trabalhador. Por sua vez, a análise jurídica do tema abrange o âmbito normativo internacional (notadamente da OIT), constitucional e celetista. A obra conclui que a tarifação do dano extrapatrimonial (art. 223-G, §1º, da CLT) é inconstitucional, pois afronta o art. 5º, incisos V e X, da Constituição Federal de 1988; viola o princípio constitucional da igualdade em virtude precificar a dignidade humana dos trabalhadores de acordo com o último salário contratual; e se distancia da valorização da dignidade humana do trabalhador.

Using a sample of 97 countries spanning the period 1980?2008, we estimate that financial crises have a large negative impact on unemployment in the short term, but that this effect rapidly disappears in the medium term in countries with flexible labor market institutions, whereas the impact of financial crises is less pronounced but more persistent in countries with more rigid labor market institutions. These effects are even larger for youth unemployment in the short term and long-term unemployment in the medium term. Conversely, large upfront, or gradual but significant, comprehensive labor market policies have a positive impact on unemployment, albeit only in the medium term.
