O presente livro, dividido em 02 (dois) volumes, articula importantes marcos teóricos sobre o Acesso à Justiça (lato sensu) com fenômenos supervenientes como a Judicialização massiva de macro e microquestões, a intensificação de debates sobre o Ativismo e a Autocontenção Judiciais e os desafios qualitativos e quantitativos da Jurisdição, à luz de teorias pós-positivistas e dialógicas e da crise numérica que atinge o Judiciário no Ocidente. Na sequência, a obra avalia o desequilíbrio democrático causado, na cena contemporânea, pela articulação de tais elementos, e pretende fornecer novas diretrizes à temática, buscadas nos intercâmbios entre a Civil Law e a Common Law. Em tal horizonte teórico, observa-se que as famílias da Civil Law e da Common Law percorrem uma intensa jornada de aproximação. Complexos intercâmbios atenuam vários dos contrastes tradicionais que, ao longo do tempo, serviram para descrever as diferenciações entre uma e outra.
