O CPC/2015 previu, no inciso IV do art. 139, a possibilidade de o juiz determinar medidas executivas atípicas, de caráter indutivo, coercitivo, mandamental ou sub-rogatória, expedidas com o desiderato de assegurar o cumprimento de ordem judicial. Todavia, dois fatores tornam a aplicação das medidas executivas atípicas tarefa extremamente complexa, quais sejam: i) o fato legislador ter se utilizado de cláusula geral; e ii) a circunstância de tais medidas processuais implicarem a colisão entre direitos fundamentais. Assim a partir da teoria de Robert Alexy e com auxílio da doutrina de Humberto Ávila, visa-se a apresentar um percurso argumentativo que pode ser seguido pelos magistrados ao conceder medidas executivas atípicas, tendo-se como premissa que a expedição de tais medidas processuais resultará em colisão entre o direito fundamental do exequente à satisfação de seu direito a uma tutela jurisdicional efetiva e vários direitos fundamentais do executado (a depender da medida executiva atípica configurada para determinada execução). No que se refere à metodologia seguida para construção do presente trabalho, realizou-se pesquisa bibliográfica, adotando-se o método dedutivo-indutivo.
