A educação para as relações étnico-raciais, obrigatória em toda rede de ensino brasileira desde os anos 2000, reflete muitos anos de luta por políticas públicas para a igualdade racial, por parte dos Movimentos Sociais Negros no Brasil. O asseguramento de uma educação que contemple a história e a cultura da África e dos afro-brasileiros nos conduz a um novo patamar de Cidadania, onde são reconhecidos e valorizados saberes tradicionais afro-brasileiros como, por exemplo, o saber tradicional da Capoeira. O presente trabalho investiga as contribuições pedagógicas possíveis da prática da Capoeira para a socioeducação de adolescentes em conflito com a lei. A Capoeira é tomada nesta investigação enquanto uma Pedagogia Social, capaz de educar em e para Direitos Humanos, colaborando com a socioeducação desses jovens e com a realização de uma educação para as relações étnico-raciais. O trabalho apresenta referências da Sociologia, Antropologia, Educação, Direitos Humanos, Psicologia e História, dentre outras disciplinas, constituindo-se como uma pesquisa do campo interdisciplinar.

O presente estudo, apesar de ter sido realizado especificamente na cidade de Salvador/BA, possui um caráter indutivo, pois a existência de imóveis abandonados é uma realidade existente em diversas cidades brasileiras, tratando-se, portanto, de um problema contemporâneo, pois inúmeros são os problemas ocasionados por estes vazios urbanos, tais como: riscos à incolumidade física dos transeuntes, podendo, em alguns casos, ocasionar a morte de pessoas, face à iminência de desabamentos; proliferação de endemias, pelo fato de serem depositários de águas paradas; riscos à segurança pública, pelo fato de serem utilizados, em muitos casos, para a prática de crimes; reserva para fins de especulação imobiliária, dentre outros, sendo que a omissão do Poder Público em relação a este problema urbano viola os Princípios da Função Social da Propriedade Privada e da Função Social da Cidade. Dessa maneira, a presente obra é inovadora no sentido de oferecer aos gestores públicos ferramentas jurídicas e institucionais que possibilitam a funcionalização desses imóveis para a efetivação de diversas políticas públicas em prol da coletividade.

A falta de efetividade das normas constitucionais é uma constante na história constitucional do País. Ao longo dos anos, nossas constituições expressaram direitos que são imprescindíveis para se garantir dignidade às pessoas, mas as instituições responsáveis por regular e implementar essas prerrogativas nem sempre evidenciaram o mesmo entusiasmo ou tiveram êxito em tornar os mandamentos constitucionais uma realidade no Brasil. No que diz respeito ao benefício assistencial a ser concedido à pessoa com deficiência em estado de miserabilidade, a questão ganha contornos ainda mais dramáticos. A não implementação de tal direito de uma forma efetiva gera risco a pessoas que já se encontram numa situação extremamente delicada, muitas vezes no limite da sobrevivência e com poucas chances de mudarem este quadro por si mesmas. Num cenário em que a Constituição garante direitos fundamentais visando ao pleno atendimento da dignidade das pessoas, mas o Poder Legislativo recalcitra do seu dever de regular tais direitos de maneira efetiva, o que fazer? Num contexto em que a Constituição visa tutelar pessoas em evidente situação de miserabilidade, mas em que o Estado e eventuais lideranças políticas transitórias não demonstram suficiente intenção de atender aos seus comandos, de que forma o impasse pode ser resolvido? Soluções inovadoras e até então impensáveis podem ser vislumbradas no marco de um constitucionalismo repensado. Que soluções são estas?
