Excerpt from A Comparative Glance at the French Code Civil and the Proposed New York Civil Code Not only is the idea and the initiative of the French Code due to Napoleon, but to a very great extent its compilation. His per sonal influence was great and most beneficial. In the elaborate discussions of its different provisions by the Commission over which he presided he evinced a profound knowl edge, an unerring judgment and a legal acumen which have excited the wonder and admiration of all jurists. Since its promulgation in 1804, the Code has remained almost unchanged excepting the abolition of divorce in 1816 and its restoration in 1884, the aboli tion of civil death in 1854, imprisonment for debt, 1867, and a few other minor changes. Its incontestible merits have won for it the attachment of the French people of all classes and stations, and the admiration of all nations. However radically different the successive govern ments in France have been, none have ever ventured to touch the Code, which has been the law of the land under two autocratic emperors, two Bourbon kings, one constitutional monarch, and three republics. There can be no greater testimonial to its excellence than this. As to the proposed Civil Code of the State of New York it is needless to enter into a statement of its sources and origin. We all know how diverse and voluminous they are, and knowing, can form some conception of the vast difficulties which have been so successfully overcome in compiling it. This book charts the formation of the French Civil Code, examining both its public and private effects. From the sixteenth to the eighteenth century, French private law was very different in the various parts of the country. In northern and central France, there were as many as sixty-five general customs in force, as well as over three hundred local customs, often differing from them in detail. As the feeling of nationhood grew, so did the idea of replacing the existing variety of laws by a single private law, possibly a code, common to all of France. 'A single body of law, called the Code Civil is to be created' proclaimed the Law of 21 March 1804, which was created by the amalgamation of thirty-six texts. The French Civil Code analyzes the Code using contemporary and modern sources, including the beautiful and concise extract from H.A.L. Fisher's History of Europe which gives an English historian's appraisal of Napoleon's contribution to the Code Civil. This text will appeal to all students of and those with an interest in international law.

The European Codification Process written by Ugo Mattei and has been published by Kluwer Law International B.V. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2003-01-01 with Law categories.

This volume contains thoughts on the issue of Codification of European Private Law and on the present state of European Private Law by one of the protagonists of the debate that is unfolding in Europe. Taking a sometimes sharply critical view, Professor Mattei attempts to unveil what he considers biases, strategies, and ideologies that affect the European legal process. The work attempts to open a basic and genuine political debate between legal scholars, which he considers an unavoidable prerequisite of any major reform process in private law. Challenging the claim of technocratic neutrality shared by much of the most influential European legal academy, the author uses the tools of Comparative Law and Economics to set priorities on the table and to show some of the real stakes of the present process. The work explores fundamental areas of European private law, from the sources' to contracts' to trust law.

In civil cases, the facts of the case are often decisive. This book provides a comparative analysis of the process of fact-finding in the litigation process. It offers theoretical insights on the distinctive features of the fact-finding arrangements in civil cases in Austria, the Netherlands, and the United States. It also examines the empirical data that sheds light on the operation of procedural rules in legal practice. The book studies specific fact-finding regulations as components of an entire system and places them in a broader context. It analyzes the history of fact-finding arrangements to elucidate the legal tradition that has shaped the mindset of practitioners and legislators. In addition, the relationship between procedural rules and the prevailing constitutional and political theory is discussed. Rules are commonly designed and adopted to promote procedural values, such as efficiency, legitimacy, accuracy, and fairness. Fact-Finding in Civil Litigation discusses the values
