Excerpt from A Comparison Between the Federal Constitutions of Canada and Australia The man who enters upon a comparison of the Federal Constitution of Canada with that of Australia has two courses open to him. Which he is to adopt will be determined by the meaning he puts upon the word "Constitution." If he interprets it to mean in each case one particular enactment of the Imperial Parliament, to which the term Constitution is usually applied, he will merely have to compare the provisions of two Acts of Parliament. But if he regards an account of the Constitution of a country as entailing a description of the structure of its different organs of government, of their powers and functions, and of their relations to one another - which, it is submitted, is the truer interpretation - his task will involve a general view of their political organisation; and to produce an adequate comparison of the two, it will require much more of him than simply to compare what we may call their Constitution Acts. The latter is the course which the present essayist has adopted. His aim has been to compare and contrast in their principal features the frames of government under which the people of Canada and Australia, respectively, have been united and live as citizens of a Federal (State, while they retain their status as subjects both of the Empire and of distinct though federated colonies. The plan pursued has been to divide the essay into two parts. In the first part the two Constitutions have been compared as types of Federal Constitutions. The nature of a Federal State has been demonstrated, its essential features described, and the presence of these characteristics of Federalism examined and compared in the respective Constitutions. In our globalized era it has become impossible to deal effectively with constitutional law and related subjects such as fundamental rights, administrative law and political science without knowledge of foreign systems. A wealth of literature is available on practically all constitutional systems and the intricacies of their application. This, however, presents the constitutionalist with a formidable problem: Which foreign systems should I explore in order to make relevant comparisons, and how should I go about it? This book addresses the core problems of comparability and appropriate comparative methodology in the realm of contemporary constitutionalism. The outcome is, however, not mere theorizing. Most of the text is devoted to an incisive application of the chosen comparative method to four geographically, historically, and culturally divergent, but thoroughly comparable, constitutional systems. In the course of the comparative exercise, contemporary constitutional dogma and constitutional mechanics are analyzed and explained, in many instances in their historical contexts, making the book itself a useful source of comparative and historical information.

Over the last twenty years, processes of pluralization, differentiation and trans-nationalization in the European Union have arguably challenged the centrality of law to European integration. Yet these developments also present opportunities to investigate new understandings of law triggered by European integration. The contributors to this book revisit one of the first academic projects to conceptualise and study European legal integration - the early 'Integration through Law' School. On this basis, they consider continuities and discontinuities in the underlying social and political landscape which the law is to integrate (the 'object' of integration), the forms and capacities of the law itself (the 'agent' of integration), and the way these two dimensions reflect on each other. Displaying different normative concerns and varied theoretical starting points, all contributors maintain that 'integration through law' remains of enduring significance to the European integration process. The volume provides a valuable reference for scholars in the field of European integration studies and European legal and political theory.

India became independent in 1947 and, after nearly three years of debate in the Constituent Assembly, adopted a Constitution that came into effect on 26 January 1950. This Constitution has lasted until the present, with its basic structure unaltered, a remarkable achievement given that the generally accepted prerequisites for democratic stability did not exist, and do not exist even today. Half a century of constitutional democracy is something that political scientists and legal scholars need to analyze and explain. This volume examines the career of constitutional-political ideas (implicitly of Western origin) in the text of the Indian Constitution or implicit within it, as well as in actual political practice in the country over the past half-century.

Interpreting Constitutions written by Jeffrey Goldsworthy and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006-02-09 with Law categories.

This book describes the constitutions of six major federations and how they have been interpreted by their highest courts, compares the interpretive methods and underlying principles that have guided the courts, and explores the reasons for major differences between these methods and principles. Among the interpretive methods discussed are textualism, purposivism, structuralism and originalism. Each of the six federations is the subject of a separate chapter written by a leading authority in the field: Jeffrey Goldsworthy (Australia), Peter Hogg (Canada), Donald Kommers (Germany), S.P. Sathe (India), Heinz Klug (South Africa), and Mark Tushnet (United States). Each chapter describes not only the interpretive methodology currently used by the courts, but the evolution of that methodology since the constitution was first enacted. The book also includes a concluding chapter which compares these methodologies, and attempts to explain variations by reference to different social, historical, institutional and political circumstances.
