O presente estudo aborda a temática da concretização do direito à educação básica de qualidade nas escolas públicas em prol da sociedade brasileira. Analisam-se questões relevantes sobre os direitos humanos, fundamentais e sociais, as características da Educação com seus conceitos e abordagem histórica, bem como os princípios que norteiam a educação básica no Brasil, perpassando pelas normas infraconstitucionais e constitucionais que estabelecem as regras do ensino na fase escolar. Refere-se, ainda, o estudo à obrigação do Estado em promover o direito social à educação básica, ressaltando a necessidade da efetivação de políticas públicas continuadas e alocação de recursos necessários para tanto. Discute-se, por fim, a problemática da concretização do direito à educação, enfatizando a escassez dos recursos na aplicação dos direitos fundamentais, o entendimento do mínimo existencial que promove a dignidade humana e, a reserva do possível defendida pelo Estado. Para essa finalidade, é utilizado o método de abordagem bibliográfico e documental, com livros e revistas direcionados ao estudo do direito fundamental social à educação básica na esfera constitucional, filosófica, social e educacional, bem como amostragem estatística da situação atual de aprendizagem em face da questão socioeconômica dos alunos e institucional das escolas públicas no país. Busca-se, com a presente pesquisa, demonstrar a importância do direito à educação como um direito humano fundamental social de modo amplo e globalizado, discutindo as problemáticas desse tema no Brasil e também demonstrando o dever do Estado em promover a educação básica de qualidade nas escolas públicas, através de políticas públicas continuadas em todas as esferas do ensino básico. Dessa maneira, proporcionam-se possibilidades iguais de inclusão da pessoa humana no mercado de trabalho para prover o seu sustento, emitir opiniões em prol de uma sociedade mais igualitária, participar das decisões político-sociais e do desenvolvimento econômico do país.

Disability-inclusive development is an essential condition for a sustainable future.
