Segundo a doutrina tradicional, a Constituição portuguesa teria criado para cada categoria de direitos fundamentais um regime próprio e distinto do regime das demais categorias. Daí teria resultado um sistema constitucional original e único: o juiz ficaria obrigado a determinar a categoria do direito em causa para apurar o regime aplicável à resolução de qualquer problema de direitos fundamentais. A nosso ver, uma tal visão é errónea e tem-se reflectido muito negativamente no labor judicial, incluindo na própria jurisprudência do Tribunal Constitucional. Neste livro indagamos como surgiu esta concepção sem paralelo em qualquer outro Estado de Direito e, sobretudo, procuramos demonstrar porquê ela subverte a vinculatividade e a natureza próprias das normas constitucionais de direitos fundamentais.
