O direito é uma disciplina axiológica, na medida em que trabalha com a emissão de juízos de valor, ou seja, como devem ser as coisas. Por isso vincula verdades por meio de valores estabelecidos pela lei ou pelo comportamento humano. Em razão desse aspecto axiológico, a verdade para o direito não se funda em medidas absolutamente seguras. O teórico para se aproximar conceitualmente de um problema deve mobilizar não apenas o arcabouço de ideias do seu campo, mas também horizontes de pensamento que a filosofia configurou. O campo de liberdade se faz de atitudes e comportamentos, e decorre da maneira pela qual os indivíduos, em suas lutas, em seus projetos, recusam as práticas que lhes são propostas, ou, muito, além disso, constituem-se como sujeitos autônomos de suas práticas.
