This introductory work proposes a fresh take on the ancient Indian concept dharma. By unfolding how, even in its developments as "law" and custom, dharma participates in nuanced and multifarious understandings of the term that play out in India’s great spiritual traditions, the book offers insights into the innovative character of both Hindu and Buddhist usages of the concept. Alf Hiltebeitel, in an original approach to early Buddhist usages, explores how the Buddhist canon brought out different meanings of dharma. This is followed by an exposition of the hypothesis that most, if not all, of the Hindu law books flowered after the third-century BC emperor Asoka, a Buddhist, made dharma the guiding principle of an entire realm and culture. A discussion built around the author’s expertise on the Sanskrit epics shows how their narratives amplified the new Brahmanical norms and brought out the ethical dilemmas and spiritual teachings that arose from inquiry into dharma. A chapter on the tale of the Life of the Buddha considers the relation between dharma, moksa/nirvana (salvation), and bhakti (devotion). Here, Hiltebeitel ties together a thread that runs through the entire story, which is the Buddha’s tendency to present dharma as a kind of civil discourse. In this sense, dharma challenges people to think critically or at least more creatively about their ethical principles and the foundations of their own spiritual values. A closing chapter on dharma in the twenty-first century explores its new cachet in an era of globalization, its diasporic implications, its openings into American popular culture, some implications for women, and the questions it is still raising for modern India.

A Treatise on Dharma, written in the fourth or fifth century, is the finest example of the genre of dharma__stra--texts on religious, civil, and criminal law and the duties of rulers--that informed Indian life for a thousand years. It illuminates major cultural innovations, such as the prominence of documents in commercial and legal proceedings, the use of ordeals in resolving disputes, and the growing importance of yoga in spiritual practices. Composed by an anonymous author during the reign of the imperial Guptas, the Treatise is ascribed to the Upanishadic philosopher Yajnavalkya, whose instruction of a group of sages serves as the frame narrative for the work. It became the most influential legal text in medieval India, and a twelfth-century interpretation came to be considered "the law of the land" under British rule. This translation of A Treatise on Dharma, based on a new critical edition and presented alongside the Sanskrit original in the Devanagari script, opens the classical age of ancient Indian law to modern readers.

Winner of the Award for Excellence in Religion: Textual Studies from the American Academy of Religion This book explores the relationship between ethics, aesthetics, and religion in classical Indian literature and literary theory by focusing on one of the most celebrated and enigmatic texts to emerge from the Sanskrit epic tradition, the Mahabharata. This text, which is widely acknowledged to be one of the most important sources for the study of South Asian religious, social, and political thought, is a foundational text of the Hindu tradition(s) and considered to be a major transmitter of dharma (moral, social, and religious duty), perhaps the single most important concept in the history of Indian religions. However, in spite of two centuries of Euro-American scholarship on the epic, basic questions concerning precisely how the epic is communicating its ideas about dharma and precisely what it is saying about it are still being explored. Disorienting Dharma brings to bear a variety of interpretive lenses (Sanskrit literary theory, reader-response theory, and narrative ethics) to examine these issues. One of the first book-length studies to explore the subject from the lens of Indian aesthetics, it argues that such a perspective yields startling new insights into the nature of the depiction of dharma in the epic through bringing to light one of the principle narrative tensions of the epic: the vexed relationship between dharma and suffering. In this first critical edition of the legal treatise of Viṣṇu (Viṣṇu Smṛti), Olivelle locates the text geographically in Kashmir and dates it to around the seventh century CE based, among other factors, on the iconographic description of Viṣṇu. The text was composed by a scholar who belonged to the Kāṭhaka Branch of the Yajur Veda and who was also an adherent of the Vaiṣṇava Pañcarātra tradition. This is the only legal text that shows a deep influence of the bhakti tradition. Although the Viṣṇu Smṛti did not have as illustrious a life as the treatises of Manu and Yājñavalkya, we find it cited frequently in medieval legal digests. Indeed, unlike citations from other Dharmaśāstras, medieval authors regularly cite entire sections of this treatise, indicating that they were familiar with a text more or less identical to the one that has come down to us. Consisting of 100 chapters, the text is framed as a conversation between Goddess Earth and Viṣṇu, with Earth requesting the dharma that should govern the lives of those belonging to the four varṇas. Originally published in the Harvard Oriental Series, this Indian edition will hopefully make this important text available to a wider Indian audience of scholars and students.
