Esta obra organizada pelos professores Cristina Keiko Yamaguchi e Gustavo Borges e pelo magistrado e doutorando Silvio Orsatto dedica-se a um fenômeno relativamente recente no País: a demanda da sociedade pela intervenção do Poder Judiciário na garantia de seus direitos à saúde. Tanto na saúde como em outras áreas, para exigir seus direitos, o cidadão brasileiro tem recorrido cada vez mais à Justiça. A chamada judicialização é, portanto, a operacionalização da relação demanda-oferta por direitos sociais mediada pelo Poder Judiciário. Quando os direitos requeridos estão relacionados à saúde, tem-se a chamada “judicialização da saúde”. Mas qual é exatamente sua causa? O que é saúde? Como ela é concebida e percebida pelos diferentes atores protagonistas ou impactados em processos de judicialização? Que princípios e diretrizes são referências para esses atores? No Brasil, essas questões são estruturais para o Sistema Único de Saúde (SUS). A partir da chamada “Constituição Cidadã”, de 1988, o sistema busca conceber saúde não mais como ausência de doenças, mas sim como uma condição ou qualidade de vida. O SUS procura seguir os chamados princípios da universalidade, equidade e integralidade. A universalidade refere-se ao dever de o Estado garantir a saúde a todos os cidadãos, como previsto na Constituição de 1988 (no Artigo 196, que considera a saúde “direito de todos e dever do Estado”). O princípio da equidade prevê que indivíduos e coletivos em condições especiais ou diferentes sejam tratados de forma especial ou diferenciada para que se tenha, enfim, igualdade. O princípio da integralidade relaciona-se ao conceito mais amplo de saúde, pois considera a pessoa para além de sua condição biológica, compreendendo-a em suas necessidades psicológicas e sociais. Inclui não somente a cura, mas, também, a proteção e a reabilitação, com consequente ampliação da carteira de serviços da saúde. Nesta obra, além da concepção da saúde como direito fundamental, os autores estudam as diferenças da judicialização nos setores público e privado, bem como causas e impactos e possibilidades de instrumentos que visem sua facilitação. Para tal, como ilustrado na Figura 1, o livro está organizado em três seções e 11 capítulos (representados por suas temáticas centrais).

A atuação judicial ativista é compatível como os princípios que norteiam o Estado Democrático de Direito? O que se propõe demonstrar nesta obra é que o ativismo judicial contraria a proposta do Estado Democrático de Direito, mas o advento do CPC de 2015, especialmente pela norma posta no artigo 489, §1º, vislumbra-se a possibilidade de cessação ou diminuição da prática ativista e o consequente fortalecimento da Constituição Federal de 1988 e da própria Democracia. El objeto del presente libro es explicitar las principales proposiciones de la, sociología funcionalista en lo que concierne al tema de las clases o de la estratificación social. Esta explicitación tiende simplemente a revelar los postulados subyacentes en la teoría funcionalista de las clases sociales, para mostrar su carácter ideológico y, por consiguiente, destruir las pretensiones de objetividad, neutralidad y carácter científico de la moderna sociología burguesa. Comienza este examen crítico con el análisis minucioso de las teorías de cuatro sociólogos que pueden ser considerados como autores “clásicos” de la sociología contemporánea: Pareto, Schumpeter, Weber y Parsons. Los teóricos más recientes de la sociología funcionalista, objeto de la segunda parte del estudio (Aron, Lenski, Dahrendorf, Touraine y otros muchos), no aportan a la teoría funcionalista de las clases ningún elemento realmente nuevo y original; repiten en un lenguaje rejuvenecido las lecciones de los grandes maestros. Aparte de la teoría' explícita de las clases, en todos estos autores está ausente la teoría general del hecho social, lo que contribuye además a que sus estudios aparezcan como objetivos, neutros y preocupados exclusivamente por los “hechos”. Por una parte, la sociología funcionalista ha convertido el estudio de las clases sociales en una «especialidad" sociológica distinta, según el principio funcionalista de la división del trabajo que separa y encierra el trabajo de los sociólogos en tantos compartimentos como hechos sociales y palabras existen para designarlos. Por otra parte, ha hecho igualmente de la teoría sociológica general y de la teoría de las clases especialidades distintas, en las que, por lo demás, nadie se interesa ya, pues la “descripción directa” de lo real es a fin de cuentas menos comprometedora para los sociólogos que su explicación. Para la autora, los postulados y el sistema de nociones ideo- lógicas que pueden desprenderse de las diversas formulaciones teóricas que analiza, se reducen a un mismo sistema de ideas: el de la ideología burguesa.

While most people are familiar with The Protestant Ethic and the Spirit of Capitalism, few know that during the last decade of his life Max Weber (1864-1920) also tried to develop a new way of analyzing economic phenomena, which he termed "economic sociology."
