An examination of the language of law in the area of political representation, this book considers the development and recognition of group claims brought pursuant to the Voting Rights Act and the Equal Protection Clause in Supreme Court opinions. In his analysis, Burke highlights the different, discursive strategies, broadly identified as liberal and communitarian, used by the Supreme Court to justify the outcomes of various cases, and he argues that no particular strategy of justification is inherently politically conservative or liberal and that no conception of political representation is unassailable. Therefore, it is unlikely that the Supreme Court will articulate a stable measure of fair representation. The Supreme Court offers one more forum in the deliberation over what is fair representation; however, it is not likely to provide minority communities with a legal answer to the problem of political underrepresentation. As such, this book tells the uncertain story of the creation of political fairness by the Supreme Court. The language used to characterize what is fair and representative, and the theoretical designs which the rhetoric reflects, allows us to formulate concepts of fair representation as legal standards evolve. By placing the debate over fair representation in not only political and legal but also philosophical terms, we are better able to understand the inevitable tensions that drive the concept of representation into new, ill-defined, and contentious areas.

"It hurts to be beautiful" has been a cliche for centuries. What has been far less appreciated is how much it hurts not to be beautiful. The Beauty Bias explores our cultural preoccupation with attractiveness, the costs it imposes, and the responses it demands. Beauty may be only skin deep, but the damages associated with its absence go much deeper. Unattractive individuals are less likely to be hired and promoted, and are assumed less likely to have desirable traits, such as goodness, kindness, and honesty. Three quarters of women consider appearance important to their self image and over a third rank it as the most important factor. Although appearance can be a significant source of pleasure, its price can also be excessive, not only in time and money, but also in physical and psychological health. Our annual global investment in appearance totals close to $200 billion. Many individuals experience stigma, discrimination, and related difficulties, such as eating disorders, depression, and risky dieting and cosmetic procedures. Women bear a vastly disproportionate share of these costs, in part because they face standards more exacting than those for men, and pay greater penalties for falling short. The Beauty Bias explores the social, biological, market, and media forces that have contributed to appearance-related problems, as well as feminism's difficulties in confronting them. The book also reviews why it matters. Appearance-related bias infringes fundamental rights, compromises merit principles, reinforces debilitating stereotypes, and compounds the disadvantages of race, class, and gender. Yet only one state and a half dozen localities explicitly prohibit such discrimination. The Beauty Bias provides the first systematic survey of how appearance laws work in practice, and a compelling argument for extending their reach. The book offers case histories of invidious discrimination and a plausible legal and political strategy for addressing them. Our prejudices run deep, but we can do far more to promote realistic and healthy images of attractiveness, and to reduce the price of their pursuit.

'The Post-Resurrection Appearance Stories of the Gospel Tradition' Although there are innumerable studies of the Easter event, the spectrum of New Testament research demonstrates an astonishing vacuum regarding a history-of-tradition analysis of the Easter appearance stories, especially in the application of the form-critical method. This study begins with a methodological review of the more recent literature and challenges the widely accepted view that the appearance stories are to be excluded from consideration of the origins of Easter faith. Because of the far-reaching confusion over the place of these stories within the complex of the resurrection traditions, Part Two scans the distinctions and relationships between them. In Part Three the author concentrates upon the appearance stories themselves and raises the following questions: Are pre-redactional forms discernible? If so, do such demonstrate by comparison similarities of form and content? Does a NT 'Gattung' stand behind them? And, finally, Part Four probes the matter of analogies in the world of primitive Christianity, while Part Five summarizes and asks provisionally if observations of a formal nature invite suggestive possibilities for further work on the question of historical experience behind the stories. An attempt at critical review of such questions is long overdue.

In Reality and Its Appearance, Nicholas Rescher aims to address the conceptual and analytical question: how does the concept of reality function and how should we think with regard to the issue of reality's relations to appearances? Rescher argues that the distinction between reality and its appearance is not a substantive distinction between two types of being, but rather relates to different ways of understanding one selfsame mode of being. The book proposes that while realism is a sensible and tenable position, nevertheless there is something to be said for idealism as well. In the cognitive as in the moral life, perfection is beyond our human grasp and we have no choice but to rest content with the best that we can manage to achieve in practice. This perspective shifts the approach from a cognitive absolutism to a pragmatism that is prepared to come to terms with the limitations inherent in our situations. On this basis Rescher defends a substantive realism that itself rests on a justificatory rationale of a decidedly pragmatic orientation.

Despite, or perhaps better by virtue of, its very brevity, Appearance and Sense is a difficult text to read and understand, particularly if we make the attempt independently of Husserl's Ideas I. This is certainly at least in part owing to the intent behind Shpet's work. On the one hand it strives to present Husserl' s latest views to a Russian philosophical audience not yet conversant with and, in all likelihood, not even aware of, his transcendental idealist turn. With this aim any reading would perforce be exacting. Yet, on the other hand, Shpet has made scant concession to his public. Indeed, his text is even more compressed, especially in the crucial areas dealing with the sense-bestowing feature of consciousness, than Husserl' s own. For all that, Shpet has not bequeathed to us simply an abbreviated paraphrase nor a selective commentary on Ideas I, although at many points it is just that. Rather, the text on the whole is a critical engagement with Husserl' s thought, where Shpet among other things refonnulates or at least presents Husserl's phenomenology from the perspective of hoping to illuminate a traditional philosophical problem in a radical manner. Since Husserl's text was published only in 1913 and Shpet's appeared sometime during 1914, the latter must have been conceived, thought through, and written in remarkable haste. Indeed, Shpet had already finished a first draft and was busy with a revision of it by the end of 1913.

Power has an appearance and appearance has power. Ideally those two would line up together and the world would be full of good, masculine men who dress and look like good masculine men. But all too often, reality is something different. There are good men and strong leaders out there who dress and look like children or bums. There are awful, lazy men in the world who dress in a way that hides their vices from those around them and makes them appear better than they truly are. In an attempt to correct for these disparities, our current culture tries to rob both appearance of its power and power of its appearance - to say that the way a person dresses or looks doesn't - or at least shouldn't matter. We're given platitudes like, "don't judge a book by its cover" and there's a often a cultural rush to prove ourselves as non-judgmental as we can. But a man's appearance has been an integral part of humanity since before the dawn of civilization. As human beings we use mental shortcuts when assessing our surroundings and the people within them. It is inefficient and dangerous to treat every object, scenario, and person as a blank slate or an unknown. And, because it is our tendency to judge according to visual stimuli, we use physicality, body language, grooming, and clothing to quickly and effectively communicate who we are and how we want other people to perceive us. Some men dress to appear more physically threatening, others to convey status and power within social spheres, some attempt to fit in and not draw attention to themselves, and others will use their clothing to show their disdain for the social norms around them. Regardless of what your intentions are, your clothing says something about you. And no, this doesn't just apply to you, but to every man who has ever interacted with another human being. From the ancient shaman, to the Wall Street banker, the Pope to the gutter punk, all men use clothing and appearance to tell the world who we are. Which means it's worthwhile for you to understand how to use this tool effectively. The purpose of this book is to outline the underlying principles of how clothing affects men and masculinity. Understanding and applying those principles will take you far beyond looking like you've been dressed by an image consultant, in one of his five variations of acceptable clothing, and into the realm of being well-dressed all the time.
