The demand for recognition, responsibility, and reparations is regularly invoked in the wake of colonialism, genocide, and mass violence: there can be no victims without recognition, no perpetrators without responsibility, and no justice without reparations. Or so it seems from law’s limited repertoire for assembling the archive after ‘the disaster’. Archival and memorial practices are central to contexts where transitional justice, addressing historical wrongs, or reparations are at stake. The archive serves as a repository or ‘storehouse’ of what needs to be gathered and recognised so that it can be left behind in order to inaugurate the future. The archive manifests law’s authority and its troubled conscience. It is an indispensable part of the liberal legal response to biopolitical violence. This collection challenges established approaches to transitional justice by opening up new dialogues about the problem of assembling law’s archive. The volume presents research drawn from multiple jurisdictions that address the following questions. What resists being archived? What spaces and practices of memory - conscious and unconscious - undo legal and sovereign alibis and confessions? And what narrative forms expose the limits of responsibility, recognition, and reparations? By treating the law as an ‘archive’, this book traces the failure of universalised categories such as 'perpetrator', 'victim', 'responsibility', and 'innocence,' posited by the liberal legal state. It thereby uncovers law’s counter-archive as a challenge to established forms of representing and responding to violence.

Drawing on original ethnographic field-research conducted primarily with former guerrilla insurgents in southern and central Sri Lanka, this book analyses the memories and narratives of people who have perpetrated political violence. It explores how violence is negotiated and lived with in the aftermath, and its implications for the self and social relationships from the perspectives of those who have inflicted it. The book sheds ethnographic light on a largely overlooked and little-understood conflict that took place within the majority Sinhala community in the late 1980s, known locally as the Terror (Bheeshanaya). It illuminates the ways in which the ethical charge carried by violence seeps into the fabric of life in the aftermath, and discusses that for those who have perpetrated violence, the mediation of its memory is ethically tendentious and steeped in the moral, carrying important implications for notions of the self and for the negotiation of sociality in the present. Modern historiography embraces the notion that time is irreversible, implying that the past should be imagined as something ‘absent’ or ‘distant.’ Victims of historical injustice, however, in contrast, often claim that the past got ‘stuck’ in the present and that it retains a haunting presence. History, Memory, and State-Sponsored Violence is centered around the provocative thesis that the way one deals with historical injustice and the ethics of history is strongly dependent on the way one conceives of historical time; that the concept of time traditionally used by historians is structurally more compatible with the perpetrators’ than the victims’ point of view. Demonstrating that the claim of victims about the continuing presence of the past should be taken seriously, instead of being treated as merely metaphorical, Berber Bevernage argues that a genuine understanding of the ‘irrevocable’ past demands a radical break with modern historical discourse and the concept of time. By embedding a profound philosophical reflection on the themes of historical time and historical discourse in a concrete series of case studies, this project transcends the traditional divide between ‘empirical’ historiography on the one hand and the so called ‘theoretical’ approaches to history on the other. It also breaks with the conventional ‘analytical’ philosophy of history that has been dominant during the last decades, raising a series of long-neglected ‘big questions’ about the historical condition – questions about historical time, the unity of history, and the ontological status of present and past –programmatically pleading for a new historical ethics.

Using a variety of theoretical reflections and empirically grounded case studies, this book examines how certain kinds of imagination – political, artistic, historical, philosophical – help us tackle the challenge of comprehending and responding to various forms of political violence. Understanding political violence is a complex task, which involves a variety of operations, from examining the social macro-structures within which actors engage in violence, to investigating the motives and drives of individual perpetrators. This book focuses on the faculty of imagination and its role in facilitating our normative and critical engagement with political violence. It interrogates how the imagination can help us deal with past as well as ongoing instances of political violence. Several questions, which have thus far received too little attention from political theorists, motivate this project: Can certain forms of imagination – artistic, historical, philosophical – help us tackle the challenge of comprehending and responding to unprecedented forms of violence? What is the ethical and political value of artworks depicting human rights violations in the aftermath of conflicts?
