Invitation to the Sociology of International Law aims to cast light on the under-explored sociological dimension of international law. The book emphasizes that international legal rules are profoundly embedded in diverse social factors and processes, such as norms, identity, and collective memory. Thus, international law often reflects and affects societal factors and processes in state societies and in the international community. The book exposes some central tenets of the sociological perspective and its core theoretical approaches, and presents a sociological analysis of several significant topics in present-day international law. Sexual Deceit is an extended ethical analysis of the phenomenon of sexual identity passing — i.e. socially presenting as X, when one understands oneself as Y, where the variables represent any contemporary sexual identity — alongside identity passing in the contexts of race, gender, and briefly, religion and class. The analysis of passing utilizes and challenges traditional moral understandings of identity falsification, complicating our understandings of moral obligations under systemic oppression. Tracing the intervention of social construction theory on contemporary political understandings of LGBT communities and activism, Sexual Deceit argues against social construction models of identity — notably performativity, promulgated by the work of Judith Butler and consumed and repeated by many scholars and theory educated queer people. A new model of identity is constructed, based on a phenomenological concept of style that provides for a socially adjustable yet rooted notion of sexual identity. The ethical implications of sexual identity passing are considered in the context of eschatological images of social justice and within practical matters such as military service, leadership, and sexual harassment law.

The U.S. no longer has a free marketplace of ideas. Instead, the marketplace is saturated with covert foreign-backed disinformation. And despite the ethical obligations to act, successive administrations have done nothing. Additionally, the decline in trust has left the door open for populism and illiberalism to enter. Some believe the very fabric of American liberalism is at stake. So what are the ethical responsibilities of the executive branch to counter covert campaigns such as the one coming from Russian-backed disinformation circulating within the US? Why has the government failed to act? So far, the practical challenges are daunting if the executive branch addresses the threat to the homeland. The process to limit this problem is wrought with profound political implications. By its very nature, social media-based disinformation is inextricably linked with existing complex societal cleavages, the First Amendment, and politics. But the failure to do anything is a serious abdication of the government’s ethical responsibilities. This raises the question of where the line is for government intervention. During the last thirty years the European Court of Human Rights has been developing,at an expanding pace, positive obligations under the European Convention. This monograph seeks to provide a critical analysis of the burgeoning case law concerning positive obligations, a topic which is relatively uncharted in the existing literature. Positive obligations require many different forms of action by member states, ranging from effectively investigating killings through to protecting peaceful demonstrators from violent attacks by their opponents. The contemporary significance of these obligations is graphically illustrated by the fact that it is the obligation upon states to provide fair trials to determine civil and criminal proceedings within a reasonable time that is the source of the overwhelming majority of complaints to the European Court in recent years. The study examines the legal bases and content of key positive obligations. Conclusions are then drawn concerning the reasons for the development of these obligations and areas of potential expansion are identified.
