Trata-se de uma tese que tem como objeto o estudo da dogmática jurídica de Direito Civil elaborada por Augusto Teixeira de Freitas. A hipótese consistiu na asserção do caráter inovador dessa dogmática. O marco temporal compreendeu o ano de 1855, quando firmou o primeiro contrato com o Governo Imperial, e o de 1872, ano da rescisão do segundo contrato. Na investigação, observou-se a posição do jurisconsulto nos campos jurídico e político, seus laços de proximidade com expoentes do Império. As obras de sistematização da legislação civil e o projeto de código civil formam o principal corpus documental da pesquisa, sem olvidar obras elaboradas após a rescisão do segundo contrato. Incorporaram-se às fontes o corpus de críticas coevas aos trabalhos de Teixeira de Freitas, em especial, de Antônio Luiz de Seabra e Antonio Pereira Rebouças. Metodologicamente, a tese orientou-se pelas lições de John Pocock e Quentin Skinner para evitar a "mitologia da doutrina" e a "mitologia da coerência". No campo da dogmática jurídica, inquiriu-se o método escolhido por Teixeira para a classificação do direito civil, mormente, o binômio "coisas"/"pessoas". Na interpretação de sua longa obra, observou-se um jurista integrado às novidades de seu tempo e marcado, também, pela tradição.

This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
