Nel diritto straniero al trustee uscente è riconosciuto un right to indemnity, che lo tutela da simili pretese; abbiamo approfondito lo stato dell’arte di questo diritto nell’ordinamento inglese e in quelli dei Paesi del modello internazionale, prendendo in esame anche le leggi straniere e la prassi adoperata all’estero, nonché le questioni generalmente connesse al passaggio delle consegne tra trustee, come il trasferimento del fondo in trust e la trasmissione dei documenti. L’analisi dei precedenti stranieri che abbiamo svolto ha dato conto di molte delle problematiche concernenti il passaggio delle consegne tra trustee e messo in luce soluzioni giuridicamente percorribili per una loro migliore gestione. Abbiamo quindi rivolto le nostre riflessioni finali alla prassi italiana, proponendo soluzioni mirate a contemperare la tutela del trustee uscente e l’intesse generale del trust e inerenti tanto l’atto istitutivo di trust quanto gli atti ricorrenti al passaggio delle consegne, quali la convenzione liberatoria.
