While many comparative analysts see parliamentary government as essential for stable democracy, this volume argues that the American presidential system that separates and diffuses power can provide new perspectives for those building democratic institutions in Latin America, Eastern Europe, and the new republics of the former Soviet Union. The authors recognize risks of rigidity, gridlock, and excessive centralization in presidential institutions. But they also emphasize the unexpected levels of legislative productivity during periods of divided government, the dramatic reversal of declining popularity by Presidents Reagan and Clinton, and the importance of direct appeals by presidents to the nation. After examining the American presidential system, the authors focus on the de-facto separation of powers in European parliaments and presidentialism in France, Latin America, and Eastern Europe. Presidents have claimed popular mandates for more than 150 years. How can they make such claims when surveys show that voters are uninformed about the issues? In this groundbreaking book, Patricia Conley argues that mandates are not mere statements of fact about the preferences of voters. By examining election outcomes from the politicians' viewpoint, Conley uncovers the inferences and strategies—the politics—that translate those outcomes into the national policy agenda. Presidents claim mandates, Conley shows, only when they can mobilize voters and members of Congress to make a major policy change: the margin of victory, the voting behavior of specific groups, and the composition of Congress all affect their decisions. Using data on elections since 1828 and case studies from Truman to Clinton, she demonstrates that it is possible to accurately predict which presidents will ask for major policy changes at the start of their term. Ultimately, she provides a new understanding of the concept of mandates by changing how we think about the relationship between elections and policy-making.

This book is open access under a CC BY 4.0 license. This book addresses the peculiarities of the current presidential election system not yet addressed in other publications. It argues that any rules for electing a President that may have a chance to replace the current ones should provide an equal representation of states as equal members of the Union, and of the nation as a whole. This book analyzes the National Popular Vote plan and shows that this plan may violate the Supreme Court decisions on the equality of votes cast in statewide popular elections held to choose state electors. That is, the National Popular Vote plan may violate the Equal Protection Clause of the Fourteenth Amendment. The book proposes a new election system in which the will of the states and the will of the nation as a whole are determined by direct popular elections for President and Vice President in the 50 states and in D.C. This system a) would elect President a candidate who is the choice of both the nation as a whole and of the states as equal members of the Union, b) would let the current system elect a President only if the nation as a whole and the states as equal members of the Union fail to agree on a common candidate, and c) would encourage the candidates to campaign nationwide. The second edition has been updated to include a proposal on how to make established non-major party presidential candidates and independent candidates welcome participants in national televised presidential debates with the major-party candidates.
