Novas tecnologias trouxeram inovação às relações de consumo. Modelos disruptivos de negócios consumeristas foram surgindo e se tornaram realidade entre nós. Plataformas de intermediação, economia de compartilhamento, proteção de dados, aprimoramento do e-commerce, foram alguns dos temas que precisaram ser aprofundados e enfrentados pelos operadores do Direito, de modo a apresentar à sociedade de consumo diretrizes para o seu efetivo funcionamento. Do ponto de vista processual, novos temas também começaram a ocupar espaço no dia a dia. A sobrecarga do Poder Judiciário justificou o estudo aprofundado de on line dispute resolutions, como forma alternativa de soluções de conflitos. Os danos coletivos, em casos de violação a direitos individuais homogêneos, também passaram por reflexões perante o Superior Tribunal de Justiça. Assim, com o objetivo principal de agregar tecnicamente aos principais e atuais temas que circundam as relações de consumo em nosso país, nosso grupo entrega mais esse trabalho coletivo que, acima de qualquer coisa, é motivo de orgulho e satisfação.

As peculiaridades que a internet atribui aos contratos de compra e venda celebrados em seu bojo ? contratos eletrônicos ? são marcantes quando se tem em foco a divergência e o inadimplemento obrigacional na fase de execução contratual. Nesse sentido, na medida em que a boa-fé e a probidade nem sempre estão presentes na atuação das partes contratantes nas relações jurídicas, além do fato da possibilidade sempre presente da ocorrência de litígios, o ideal é que haja meios que resguardem o comprador de fraudes, e, em simetria, desestimulem o vendedor de práticas lesivas. A solução mais eficaz para toda a problemática que gravita em torno do contrato eletrônico de compra e venda é a atuação de um terceiro representando, tanto o comprador, quanto o vendedor, portanto, externo à compra e venda, atuando como guardião do preço, para fins de controlar o repasse do pagamento ao vendedor e de fiscalizar a entrega do bem ao comprador. Nesse cenário, são exemplos de exploração desse nicho mercadológico "Mercado Livre", Pay Pal e "Mercado Pago." Destarte, erigiu-se, como a mais eficaz proposta de solução às controvérsias suscetíveis de ocorrerem nessa "relação jurídica virtual" e de tutela da efetividade dos negócios eletrônicos de compra e venda firmados, o instituto do Contrato de Intermediação e seu mais característico personagem, o Agente Intermediador.

Desde o Relatório sobre a Indústria de Cartões de Pagamento publicado em 2005, o Estado tem atuado no setor de meios de pagamento por meio do sistema de defesa da concorrência e da sua regulação. A Lei no 12.865/2013, marco regulatório do setor, não abordou o subcredenciador. Mas, durante as discussões sobre a implementação da liquidação centralizada, a atuação do subcredenciador e sua relevância ficaram mais evidentes. Em 2018, o Banco Central esclareceu parcialmente as incertezas sobre sua caracterização e forma de participação nos arranjos de pagamento, publicando a Circular no 3.886/2018. A princípio, o subcredenciador não é diretamente regulado, mas a regulação gera diversos efeitos nas suas atividades, que se desenvolvem no âmbito dos arranjos e a partir dos relacionamentos firmados com as bandeiras e os credenciadores. Este estudo consolida e analisa os efeitos do arcabouço jurídico existente e que se impõe ao subcredenciador, inclusive a partir de entrevistas realizadas com diversos operadores do setor, além de refletir sobre problemáticas do subcredenciador, como a especificação dos riscos gerados por ele e as formas de monitoramento adotadas, o compartilhamento de informações concorrencialmente sensíveis, a compatibilidade dos contratos aplicados a este player, a excepcionalidade do marketplace e a extensão da responsabilidade do credenciador na falta de liquidação das transações de pagamento capturadas pelo subcredenciador.

In the eighteenth century, when the Bill of Rights was drafted, the spectacle of state agents breaking into a citizen's home and rummaging through his or her private diaries was considered the paradigm case of an unconstitutional search and seizure. But during the impeachment of President Bill Clinton, prosecutors were able to subpoena Monica Lewinsky's bookstore receipts and to retrieve unsent love letters from her home computer. And the sense of violation that Monica Lewinsky experienced is not unique. In a world in which everything that Americans read, write, and buy can be recorded and monitored in cyberspace, there is a growing danger that intimate personal information originally disclosed only to our friends and colleagues may be exposed to--and misinterpreted by--a less understanding audience of strangers. Privacy is important, Rosen argues, because it protects us from being judged out of context in a world of short attention spans, a world in which isolated bits of intimate information can be confused with genuine knowledge. Rosen also examines the expansion of sexual-harassment law that has given employers an incentive to monitor our e-mail, Internet browsing habits, and office romances.
