Fifty years after President Dwight D. Eisenhower ordered troops to Little Rock, Arkansas, to enforce a federal court order desegregating the city's Central High School, a leading authority on Eisenhower presents an original and engrossing narrative that places Ike and his civil rights policies in dramatically new light. Historians such as Stephen Ambrose and Arthur Schlesinger, Jr., have portrayed Eisenhower as aloof, if not outwardly hostile, to the plight of African-Americans in the 1950s. It is still widely assumed that he opposed the Supreme Court's landmark 1954 Brown v. Board of Education decision mandating the desegregation of public schools, that he deeply regretted appointing Earl Warren as the Court's chief justice because of his role in molding Brown, that he was a bystander in Congress's passage of the civil rights acts of 1957 and 1960, and that he so mishandled the Little Rock crisis that he was forced to dispatch troops to rescue a failed policy. In this sweeping narrative, David A. Nichols demonstrates that these assumptions are wrong. Drawing on archival documents neglected by biographers and scholars, including thousands of pages newly available from the Eisenhower Presidential Library, Nichols takes us inside the Oval Office to look over Ike's shoulder as he worked behind the scenes, prior to Brown, to desegregate the District of Columbia and complete the desegregation of the armed forces. We watch as Eisenhower, assisted by his close collaborator, Attorney General Herbert Brownell, Jr., sifted through candidates for federal judgeships and appointed five pro-civil rights justices to the Supreme Court and progressive judges to lower courts. We witness Eisenhower crafting civil rights legislation, deftly building a congressional coalition that passed the first civil rights act in eighty-two years, and maneuvering to avoid a showdown with Orval Faubus, the governor of Arkansas, over desegregation of Little Rock's Central High. Nichols demonstrates that Eisenhower, though he was a product of his time and its backward racial attitudes, was actually more progressive on civil rights in the 1950s than his predecessor, Harry Truman, and his successors, John F. Kennedy and Lyndon Johnson. Eisenhower was more a man of deeds than of words and preferred quiet action over grandstanding. His cautious public rhetoric -- especially his legalistic response to Brown -- gave a misleading impression that he was not committed to the cause of civil rights. In fact, Eisenhower's actions laid the legal and political groundwork for the more familiar breakthroughs in civil rights achieved in the 1960s. Fair, judicious, and exhaustively researched, A Matter of Justice is the definitive book on Eisenhower's civil rights policies that every presidential historian and future biographer of Ike will have to contend with.

Against the background of the law reform debates around sexuality in Britain and America, Bamforth examines what functions it is legitimate for the law to serve and how effective law can be in achieving social goals. He provides a new and cogent argument for protecting lesbian and gay rights through law, but is sceptical about how useful law can be in eradicating discriminatory social practices. This work sheds new light on the equal rights debate and raises issues of central importance to the role of law in society.

A Simple Justice written by Melanie Beals Goan and has been published by University Press of Kentucky this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-11-12 with History categories.

When the Declaration of Independence was signed by a group of wealthy white men in 1776, poor white men, African Americans, and women quickly discovered that the unalienable rights it promised were not truly for all. The Nineteenth Amendment eventually gave women the right to vote in 1920, but the change was not welcomed by people of all genders in politically and religiously conservative Kentucky. As a result, the suffrage movement in the Commonwealth involved a tangled web of stakeholders, entrenched interest groups, unyielding constitutional barriers, and activists with competing strategies. In A Simple Justice, Melanie Beals Goan offers a new and deeper understanding of the women's suffrage movement in Kentucky by following the people who labored long and hard to see the battle won. Women's suffrage was not simply a question of whether women could and should vote; it carried more serious implications for white supremacy and for the balance of federal and state powers -- especially in a border state. Shocking racial hostility surfaced even as activists attempted to make America more equitable. Goan looks beyond iconic women such as Susan B. Anthony and Elizabeth Cady Stanton to reveal figures whose names have been lost to history. Laura Clay and Madeline McDowell Breckinridge led the Kentucky movement, but they did not do it alone. This timely study introduces readers to individuals across the Bluegrass State who did their part to move the nation closer to achieving its founding ideals.

Sexual rules and regulations are among society‘s oldest yet it is only in recent decades that this once-stigmatized field has become the focus of scholarly attention. This volume, which includes some of the most thought-provoking and hard-to-find essays in the field, covers a diverse range of topics from sexual orientation and gender identity to intersexuality and commercial sex, and from HIV/AIDS and trafficking to polygamy. Through historical, political and critical-theoretical lenses, and through a global focus, the selections ask how we conceptualize the groups and acts subjected to sexual regulation and how regulations in the field implicate and produce understandings of sexuality and identity. By placing this variety of works together, Sexuality and Equality Law invites fresh insights into commonalities and synergies across regulatory arenas that are often isolated from one another. The volume‘s introduction situates all of these works in the broader field and offers readers an extensive bibliography.

This collection is in honour of Adrian Zuckerman, Emeritus Professor of Civil Procedure at the University of Oxford. Bringing together a distinguished group of judges and academics to reflect on the impact of his work on our understanding of civil procedure and evidence today. An internationally renowned scholar, Professor Zuckerman has dedicated his professional life to the law of evidence and civil procedure, drawing attention to the principles and policies that shape litigation practice and their wider social impact. His pioneering scholarship is admired by the judiciary and the academy and has influenced several major reforms of the civil justice system including the Woolf Reforms that heralded the introduction of the Civil Procedure Rules, and Lord Justice Jackson's Review of Civil Litigation Costs. His work has also informed law reform bodies and courts in other jurisdictions. Building upon Professor Zuckerman's work, the contributors address outstanding problems in the field of civil procedure and evidence, and in keeping with Adrian's record of always exploring new areas, the book includes chapters on the prospects for a digital justice system, including the new online court being developed in England and the potential role of algorithms in the court room.
