This volume in the Brill Research Perspectives in Comparative Discrimination Law addresses intersectionality from the lens of comparative antidiscrimination law. The term ‘intersectionality’ was coined by Kimberlé Williams Crenshaw in 1989. As a field, intersectionality has a longer history, of nearly two hundred years. Meanwhile, comparative antidiscrimination law as a field may be just over a few decades old. Thus, intersectionality’s tryst with antidiscrimination law is a fairly recent one. Developed as a critique of antidiscrimination law, intersectionality has had a significant influence on it. Yet, intersectionality’s logic does not seem to have infiltrated the logic of antidiscrimination law completely. Comparative antidiscrimination law continues to develop with intersectionality in sight, but rarely, in step. On the occasion of the 30th anniversary of Crenshaw’s seminal article that coined the term in the context of antidiscrimination law, Shreya Atrey explores this irony. Her article provides a meta-narrative of the development of the two fields with the purpose of showing what appear to be orthogonal trajectories.

In 1882, Elmer Palmer was convicted of poisoning his grandfather Francis in rural northern New York State. In a famous decision in 1889, the New York Court of Appeals denied Elmer the right to inherit from Francis, even though the statute governing wills seemed to entitle him to the legacy. Twentieth-century commentators have treated Riggs v. Palmer as a model of the judicial craft and a key to understanding the nature of law itself; however, the case’s history suggests that it is neither of these things. In its own time, the decision was radically at odds with legal doctrine as then understood by American judges. Rather than a quintessentially principled ruling, it was most likely ad hoc and ad hominem, concocted to thwart a particular individual thought to have been punished too lightly for his crime. The book illustrates the value of two approaches to interpreting decisions, those of "case biography" and "legal archaeology." Both draw upon historical sources neglected in conventional legal scholarship. In doing so, they may challenge—or confirm—the validity as precedent today of classic cases from the past.

Is it really possible to love one’s enemies? That’s the question that sparked a fascinating and, at times, terrifying journey into the heart of the Middle East during the summer of 2008. It was a trip that began in Egypt, passed beneath the steel and glass high rises of Saudi Arabia, then wound through the bullet- pocked alleyways of Beirut and dusty streets of Damascus, before ending at the cradle of the world’s three major religions: Jerusalem. Tea with Hezbollah combines nail-biting narrative with the texture of rich historical background, as readers join novelist Ted Dekker and his co-author and Middle East expert, Carl Medearis, on a hair-raising journey. They are with them in every rocky cab ride, late-night border crossing, and back-room conversation as they sit down one-on-one with some of the most notorious leaders of the Arab world. These candid discussions with leaders of Hezbollah and Hamas, with muftis, sheikhs, and ayatollahs, with Osama bin Laden’s brothers, reveal these men to be real people with emotions, fears, and hopes of their own. Along the way, Dekker and Medearis discover surprising answers and even more surprising questions that they could not have anticipated—questions that lead straight to the heart of Middle Eastern conflict. Through powerful narrative Tea With Hezbollah will draw the West into a completely fresh understanding of those we call our enemies and the teaching that dares us to love them. A must read for all who see the looming threat rising in the Middle East.

This book provides an in-depth analysis of the central concepts figuring in equality and non-discrimination standards across jurisdictions: formal and substantive equality, direct and indirect discrimination, reasonable accommodation, affirmative action and intersectional discrimination. It explains how different conceptualizations matter and may result in different outcomes in legislation, case law and policies. In doing so it draws on examples from a wide variety of sources, including the European, Inter-American and global human rights systems and the jurisprudence of the apex courts in Canada, India, South Africa and the US. This study also shows how the conceptualization of equality has been moving overall from formal to more substantive equality.

This book is a succinct and readable account of recent research at Gordion, the ancient capital of Phrygia, long one of the key sites for understanding Iron Age Anatolia. The regional survey at Gordion has involved a range of interdisciplinary studies—archaeological, environmental, and ethnoarchaeological—to produce an unusually comprehensive understanding of how the landscape evolved, the patterns of settlement during the rise and fall of the Phrygian state, and its environmental constraints. With a history of excavation of over a century, Gordion has yielded a vast store of material culture, some of which is spectacular. The Midas tumulus, the architecture of the Phrygian citadel, and the artifacts from several decades of excavations present unique challenges and solutions for conservation methodology. Analyses of these artifacts are providing new insights into the political and economic relationships of this region, particularly from the Early Iron Age to the Roman period. Presenting current work at Gordion contributes to the broader understanding of archaeology across the region and around the world.
