Excerpt from A Treatise on the Property Rights of Husband and Wife, Under the Community or Ganancial System The subject considered in this work has never been treated with any view to a thorough and exhaustive presentation of the principles upon which it is founded, or the enunciation of the courts thereon. The system being an outgrowth of customs and laws entirely foreign, and to some extent antagonistic to common law principles, necessarily fills the mind of one cultured under English jurisprudence with many doubts and perplexities. The community system of property rights as existing in the States of the Union, has seemed to me to be of sufficient importance to merit a separate treatise thereon. The present work, therefore, has been undertaken with a view of removing, so far as is in my power, such uncertainties as shroud the primitive principles underlying this system, and with the further purpose of giving to the profession a harmonious and succinct statement of the doctrines applicable to the community system existing in the several States. There has, also, been present throughout its preparation a desire to make this work a safe and intelligent guide to lead the practitioner and the courts into a clear and full understanding of the real import of this system of property rights, to the ultimate end that its principles may be crystallized into a perfect and clearly defined branch of our jurisprudence. Excerpt from A Treatise on the Law of Husband and Wife The ground-work of the present volume on the law of Husband and Wife will be found in a treatise of some three hundred pages which the author's earlier work on the Domestic Relations contains. But when that treatise was written, the Married Women's Acts in England and America were a sort of first experiment or agitation; and since the second edition of the Domestic Relations not less than three thousand points have been decided, all tending to establish a mod ern jurisprudence concerning married women's rights, which decisions the author has examined while pre paring the present work, in addition to earlier author ities and various local codes. He has consequently expanded his subject, re-arranged his plan, and revised and re-written every topic, and the present work will be found essentially a new one, so far as relates espe cially to Promises to Marry, the Wife's Separate Pr0p erty under Equity and Recent Statutes, Transactions between Husband and Wife, Various Matters of Prac tice, and Separation and Divorce. A summary of the late Married Women's Acts in England and the United States will be found in the Appendix. No one can gain an intelligent comprehension of the rights and disabilities of the marriage union, as they exist to-day, without examining in order, (1) the old common-law or coverture doctrine; (2) the modifica tion of that doctrine by equity and recent legislation; (3) the latest local statute (judicially construed or not) which bears upon the particular point. But, on closer ex amination, I discovered that Roper's work is inferior, both in language and arrangement, to his Treatise upon Legacies; and that Jacob, in his edition of it, published so long back as the year 1826, has allowed the original text to remain untouched, by keeping his own contributions distinct, (either inclosed within brackets, or put in the shape of foot-notes), and has, there fore, left the reader to adjust for himself any difference or inconsistency between the author and the 'editor.
