Atualmente, há uma carência de infraestrutura estatal, consistente na destinação de bens móveis e imóveis ao controle e à fiscalização do atendimento de normas ambientais, emergindo a necessidade de uma estrutura organizacional da Administração Pública, cuja finalidade seria a de compatibilizar o incremento de infraestruturas com o equilíbrio socioambiental. Esse controle requer uma abordagem interdisciplinar, o que permite a compreensão da totalidade da situação e a escolha das melhores estratégias de intervenção, além de abrir caminho para a relação de interação entre as diversas áreas. É esse contexto, de evidente necessidade de máxima mobilização social e carência de infraestrutura estatal, que o presente estudo toma como ponto de partida. Apoiando-se nos marcos teóricos da descentralização do serviço público de registro imobiliário – pelo regime jurídico de delegação e da publicidade registral –, pela oponibilidade erga omnes das informações tabulares, avança no cordão nevrálgico do estudo, analisando a potência da publicidade registral como uma eficaz ferramenta de controle do atendimento da função socioambiental da propriedade. Percorridos os marcos teóricos referenciados, encontrar-se-á o ponto central do presente estudo. The time has come for us to collectively reexamine—and ultimately move past—the concept of sustainability in environmental and natural resources law and management. The continued invocation of sustainability in policy discussions ignores the emerging reality of the Anthropocene, which is creating a world characterized by extreme complexity, radical uncertainty, and unprecedented change. From a legal and policy perspective, we must face the impossibility of even defining—let alone pursuing—a goal of “sustainability” in such a world. Melinda Harm Benson and Robin Kundis Craig propose resilience as a more realistic and workable communitarian approach to environmental governance. American environmental and natural resources laws date to the early 1970s, when the steady-state “Balance of Nature” model was in vogue—a model that ecologists have long since rejected, even before adding the complication of climate change. In the Anthropocene, a new era in which humans are the key agent of change on the planet, these laws (and American culture more generally) need to embrace new narratives of complex ecosystems and humans’ role as part of them—narratives exemplified by cultural tricksters and resilience theory. Updating Aldo Leopold’s vision of nature and humanity as a single community for the Anthropocene, Benson and Craig argue that the narrative of resilience integrates humans back into the complex social and ecological system known as Earth. As such, it empowers humans to act for a better future through law and policy despite the very real challenges of climate change.

Land and real estate reforms have not been effective at achieving their objectives, in part because of how they have been designed and implemented. To be successful, reforms must become comprehensive in design, argue the authors, although implementation may be phased over time and take local conditions into account. Reform must include three elements: 1) Institutional reforms that better define property rights, reduce information asymmetry, and improve contract enforcement. 2) Capital market reforms that make mortgage finance available at reasonable rates, especially for the poor. 3) Market reforms that reduce or eliminate the main distortions in the prices of goods and services produced by land and real estate assets. In their review of land and real estate reforms supported by the World Bank, the authors find that such reforms receive less attention at the conceptual stage than they should, considering their great impact on poverty, growth, and stability. They base their conclusion on the limited coverage of land and real estate issues in country assistance strategies, the main vehicle for identifying priority areas for reform. Most Bank-supported projects do not address all three elements critical for reform. And most provide no justification for excluding them, and no plan for follow-up. The Bank's Operations Evaluation Department rates Bank-supported land and real estate projects relatively well on outcome and sustainability but not on institutional development. But land and real estate reform is institutional by nature. The authors urge the Bank and policymakers to change course. After a comprehensive assessment of the status of real estate institutions and markets, all actors in this sector should be pulled together to develop a comprehensive approach to land and real estate reform.
