Since the 1980s, neoliberals have openly contested the idea that the state should protect the socio-economic well-being of its citizens, making ‘privatization’ their mantra. Yet, as historians and social scientists have shown, welfare has always been a ‘mixed economy’, wherein private and public actors dynamically interacted, collaborating or competing with each other in the provision of welfare services. This book will be of interest to students, scholars and practitioners of welfare by developing three innovative approaches. Firstly, it illuminates the productive nature of public/private entanglements. Far from amounting to a zero-sum game, the interactions between the two sectors have changed over time what welfare encompasses, its contents and targets, often engendering the creation of new fields of intervention. Secondly, this book departs from a well-established tradition of comparison between Western nation-states by using and mixing various scales of analysis (local, national, international and global) and by covering case studies from Spain to Poland and France to Greece in the nineteenth and twentieth centuries. Thirdly, this book goes beyond state centrism in welfare studies by bringing back a host of public and private actors, from municipalities to international organizations, from older charities to modern NGOs. The year 2000's most significant international event was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.

The notion of market power is central to antitrust law. Under EU law, antitrust rules refer to appreciable restrictions of competition (Article 101(1) Treaty on the Functioning of the European Union (TFEU), ex Article 81(1) EC Treaty), the elimination of competition for a substantial part of the market (Article 101 (3) TFEU, ex Article (81(3) EC), dominant positions (Article 10 (2) TFEU, ex Article 82 EC), and substantial impediment to effective competition, in particular by creating or reinforcing a dominant position (Article 2 of the EU Merger Regulation). At first sight, only the concept of dominant position relates to market power, but it is the aim of this book to demonstrate that the other concepts are directly linked to the notion of market power. This is done by reference to the case law of the EU Courts and the precedents of the European Commission. The author goes on to argue that for very good reasons (clarity and enforceability, among others) the rules should be interpreted in this way. Beginning with market definition, the book reviews the different rules and the different degrees of market power they incorporate. Thus it analyses the notion of 'appreciable restriction of competition' to find a moderate market power obtained by agreement among competitors to be the benchmark for the application of Article 101 TFEU, ex Article 81 EC. It moves on to the concept of dominance under Article 102 TFEU (ex Article 82 EC), which is equivalent to substantial (or sgnificant) market power, and then focuses on the old and new tests for EU merger control. Finally, it addresses the idea of elimination of competition in respect of a substantial part of the market (Article 101 (3) TFEU, ex Article 81 (3) (b) EC), in which the last two types of market power (Article 102 TFEU, ex Article 82 EC and EU Merger Regulation) converge. To exemplify this, an in-depth study of the notion of collective dominance is conducted. The book concludes that a paradigm of market power exists under the EU antitrust rules that both fits with past practice and provides for a useful framework of analysis for the general application of the rules by administrative and even more importantly judicial authorities in the Member States, under conditions of legal certainty.
