Die Beteiligung von ehrenamtlichen Personen im Widerspruchsverfahren ist in mehreren Rechtskreisen normiert. Neben einer Öffnungsklausel im allgemeinen Verwaltungsverfahrensrecht, wo gem. § 73 Abs. 2 VwGO die Bildung von Widerspruchsausschüssen möglich ist, finden sich auch im Sozialverwaltungsverfahrensrecht Mitwirkungsmöglichkeiten durch ehrenamtliche Personen im Widerspruchsverfahren. So werden in der Sozialhilfe gem. § 116 Abs. 2 SGB XII in bestimmten Fällen sozial erfahrene Dritte im Widerspruchsverfahren beratend beteiligt. Ebenso kann in den in § 1 Abs. 1 S. 1 SGB IV genannten Sozialversicherungsträgern der Erlass von Widerspruchsbescheiden besonderen Ausschüssen übertragen werden, sog. Widerspruchsausschüssen. Eine derartige Beteiligungsform findet sich hingegen nicht im Bereich der Arbeitsverwaltung, weder in der Arbeitsförderung (SGB III) noch in der Grundsicherung für Arbeitsuchende (SGB II). Zwei Jobcenter haben sich dennoch ein Verfahren zunutze gemacht, welches durch die Mitwirkung von ehrenamtlichen Personen im Widerspruchsverfahren gekennzeichnet ist. In der vorliegenden rechtsempirischen Arbeit werden die praktizierten Widerspruchsverfahren beider Jobcenter dargestellt und analysiert. Auf Grundlage der dem Widerspruchsverfahren zugeschriebenen Funktionen wird schließlich die Wirkung der Beteiligung ehrenamtlicher Personen im Widerspruchsverfahren geprüft.
