From its beginnings in the early 1970s, the Aboriginal Legal Service of Western Australia has been influential in national campaigns to address the legacies of dispossession and human rights abuses. It continues to play a central role in advocating for measures to address Aboriginal deaths in custody, land rights and stolen generations, not just in WA but as issues of national significance. A lively and multi-dimensional account, Justice: A History of the Aboriginal Legal Service of Western Australia shows the human face of some of the nations major social, political and legal reforms of the last four decades. It is the story of people determined to protect and defend the human rights of those Australians whose rights have been routinely abused.

The Australian Government has provided funding to evaluate the effectiveness of Indigenous law and justice programs across five subject areas to identify the best approaches to tackling crime and justice issues and better inform government funding decisions in the future. This report presents the findings of subject area "C", 'Diversion programs'. It examined the impact of four programs designed to divert Indigenous people from entering the justice system. The four programs sit at different points along a continuum, ranging from prevention (addressing known risk factors for offending behaviour), early intervention (with identified at-risk young people), diversion (diverting from court process - usually for first or second time offenders), and tertiary intervention (treatment to prevent recidivism). The programs evaluated were: Aboriginal Power Cup, a sports-based prevention program in South Australia; Tiwi Islands Youth Development and Diversion Unit, an early intervention and diversion program that engages Tiwi youth who are at-risk of entering the criminal justice system in prevention activities; Woorabinda Early Intervention Panel Coordination Service, an assessment and referral program for early intervention and diversion, in Queensland; and Aggression Replacement Training, a group cognitive-behavioural program for youth assessed as at risk of offending or re-offending, also in Queensland.

"Thousands of recommendations have been made over the past ten years to make the criminal justice system more responsive to the needs of Aboriginal people. Yet Aboriginal people remain over-represented in prisons and subject to systemic discrimination throughout the justice system. While previous commissions have focused on reforming the existing justice system, the Royal Commission's major contribution is to examine another road - the creation of Aboriginal justice systems, and how these could work alongside the existing system. The report reviews current Aboriginal justice initiatives including Aboriginal policing, Aboriginal courts, elders panels and sentencing circles. Two case studies of successful justice initiatives provide lessons for both governments and Aboriginal people wishing to take this road. The greatest challenge is to create conceptual and constitutional space for Aboriginal justice systems. The Commission explores the jurisdictional basis for the creation of Aboriginal justice systems in Canada, as well as how jurisdictional conflicts with the federal and provincial governments could be resolved. Issues include the application of the Charter of Rights and Freedoms and the Criminal Code to Aboriginal justice systems, ensuring the safety of women and children, dealing with appeals, and Aboriginal justice in urban centres. For the first time, we see what Aboriginal justice systems might look like. The Commission concludes the report with recommendations for reforming the existing justice system, and the cost to Canadians of continued inaction."--publications.gc.ca.

"There was a widespread view among participants at the Round Table that the current justice system, especially the criminal justice system, is too centralized, too legalistic, too formal and too removed from the (Aboriginal) communities it is supposed to serve."--

Justice, Indigenous Peoples, and Canada: A History of Courage and Resilience brings together the work of a number of leading researchers to provide a broad overview of criminal justice issues that Indigenous people in Canada have faced historically and continue to face today. Both Indigenous and Canadian scholars situate current issues of justice for Indigenous peoples, broadly defined, within the context of historical realities and ongoing developments. By examining how justice is defined, both from within Indigenous communities and outside of them, this volume examines the force of Constitutional reform and subsequent case law on Indigenous rights historically and in contemporary contexts. It then expands the discussion to include theoretical considerations, particularly settler colonialism, that help explain how ongoing oppressive and assimilationist agendas continue to affect how so-called "justice" is administered. From a critical perspective, the book examines the operation of the criminal justice system, through bail, specialized courts, policing, sentencing, incarceration and release. It explores legal frameworks as well as current issues that have significantly affected Indigenous peoples, such as the Truth and Reconciliation Commission, the Inquiry into Missing and Murdered Indigenous Women and Girls, human rights, resurgence and identity. This unique collection of perspectives exposes the disconcerting agenda of historical and modern-day Canadian federal government policy and the continued denial of Indigenous rights to self-determination. It is essential reading for those interested in the struggles of the Indigenous peoples in Canada as well as anyone studying race, crime and justice.

Conflict Politics And Crime written by Chris Cunneen and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-07-28 with Social Science categories.

Aboriginal people are grossly over-represented before the courts and in our gaols. Despite numerous inquiries, State and Federal, and the considerable funds spent trying to understand this phenomenon, nothing has changed. Indigenous people continue to be apprehended, sentenced, incarcerated and die in gaols. One part of this depressing and seemingly inexorable process is the behaviour of police. Drawing on research from across Australia, Chris Cunneen focuses on how police and Aboriginal people interact in urban and rural environments. He explores police history and police culture, the nature of Aboriginal offending and the prevalence of over-policing, the use of police discretion, the particular circumstances of Aboriginal youth and Aboriginal women, the experience of community policing and the key police responses to Aboriginal issues. He traces the pressures on both sides of the equation brought by new political demands. In exploring these issues, Conflict, Politics and Crime argues that changing the nature of contemporary relations between Aboriginal people and the police is a key to altering Aboriginal over-representation in the criminal justice system, and a step towards the advancement of human rights.

Indigenous Criminology written by Cunneen, Chris and has been published by Policy Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-07-27 with Social Science categories.

Indigenous Criminology is the first book to comprehensively explore Indigenous people’s contact with criminal justice systems in a contemporary and historical context. Drawing on comparative Indigenous material from North America, Australia and Aotearoa New Zealand, it addresses both the theoretical underpinnings to the development of a specific Indigenous criminology, and canvasses the broader policy and practice implications for criminal justice. Written by leading criminologists specialising in Indigenous justice issues, the book argues for the importance of Indigenous knowledges and methodologies to criminology, and suggests that colonialism needs to be a fundamental concept to criminology in order to understand contemporary problems such as deaths in custody, high imprisonment rates, police brutality and the high levels of violence in some Indigenous communities. Prioritising the voices of Indigenous peoples, the work will make a significant contribution to the development of a decolonising criminology and will be of wide interest.

Reclaiming Aboriginal Justice Identity And Community written by Craig Proulx and has been published by Purich Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2003 with History categories.

Justice for Aboriginal peoples in an urban context is a complex issue, which should involve consideration of healing, tradition, and community, but rarely does. In his analysis of justice issues facing urban Aboriginals, Proulx pays particular attention to the situation of Aboriginal peoples in Canada, and how the current justice system has failed them. He looks at alternatives to the current system, examining in detail the Community Council Project (CCP), an Aboriginal-run diversion program in Toronto. The analysis of the CCP shows how effective, culturally appropriate, alternative justice mechanisms can provide justice for those not well served by the current system. Describing and analyzing an alternative way of thinking about crime and justice is at the heart of this timely and far-reaching book. Proulx shows how justice, healing, and community intersect, drawing on the example of the CCP. He discusses what constitutes the Aboriginal community in Toronto, and how the CCP is playing an important role in shaping and defining the community. Among other issues addressed in the book are: crime causation; Indigenous justice knowledge and practice; healing; changes in tradition and culture; and personal and community ownership and empowerment.
