Deliberar sobre el aborto no siempre ha sido fácil, pero deliberar sobre el aborto desde el Derecho y entre personas que operan en el Derecho ha resultado particularmente difícil en la Argentina. Ante esa dificultad, con la excepción de algunas voces rebeldes, el silencio ha sido la opción de la mayoría de quienes ejercieron roles de liderazgo en las profesiones del Derecho, incluso varias décadas después de 1983. En los últimos años, este silencio extendido se ha ido desarmando de la mano de voces feministas, profesionales de la salud y del Derecho, integrantes de organizaciones de derechos humanos, universidades y un largo etcétera. Desde distintas perspectivas, nuevas y viejas actoras reclaman con frecuencia la reforma de la legislación vigente y se movilizan para exigir el acceso a los abortos legales según el artículo 86 del Código Penal de la Nación. Mientras tanto, el poder judicial reconoce cada vez más los derechos de las mujeres, y algunos líderes de los partidos políticos anuncian posiciones menos maniqueas y/o la libertad de conciencia frente al tema. Los medios de comunicación, por su parte, han dejado de enmarcar el debate como si fuera un juego de suma cero. En ese contexto, el debate sobre la injusticia de la aplicación del Derecho penal para coartar las decisiones reproductivas de las mujeres es todavía una cuestión pendiente. Partiendo del reconocimiento de esa deuda, este libro ofrece una variedad de ideas, argumentos, investigaciones de juristas de diversos puntos de la Argentina y de Iberoamérica con el fin de abordar como cuestión constitucional el empleo de opciones punitivas en la regulación de las decisiones reproductivas de las mujeres y de otras personas con capacidad para gestar.
