Ralf Uhrich widmet sich einer der zentralen Fragestellungen des Patentrechts: dem Schutz chemischer Stoffe und dessen Ausgestaltung. Nach einer grundlegenden Auseinandersetzung mit der Geschichte des Stoffschutzes sowie den rechtsokonomischen Implikationen analysiert er umfassend die nationalen, europaischen und volkerrechtlichen Rahmenbedingungen. Untersuchungsgegenstand sind dabei neben chemischen auch biotechnologische, pharmazeutische sowie nanotechnologische Stofferfindungen. Der Autor gelangt zu dem Ergebnis, dass weniger der absolute Stoffschutz selbst als vielmehr die Handhabung der Patenterteilungsvoraussetzung der erfinderischen Tatigkeit problematisch ist. Ausgehend davon entwickelt er einen technologieunabhangigen Losungsansatz, der grundsatzlich am absoluten Stoffschutz festhalt, gleichwohl aber diesen durch eine Neuausrichtung der Prufung der erfinderischen Tatigkeit korrigiert.

In recent years the impact of human rights and fundamental rights on private law has risen in prominence and led to a whole series of detailed investigations. 'Constitutionalization of private law' is the flag under which most of the research on the increasing impact of national constitutional rights on national private legal orders is sailing. In the absence of a European Constitution, the constitutionalization of European private law suggests a process: constitutionalization instead of constituent power, demos, and the magic constitutional moment. The Charter of Fundamental Rights and the European Convention of Human Rights constitute the two pillars on which the transformation of European private law rests. Initially genetic disorders were all considered as rare diseases. At present, in the mid of 2009, the OMIM catalogue contains information on more than 12 000 entries of which about 2500 are available for clinical testing based on the identification of the responsible gene defect. However, altogether it has been estimated that about 8 percent of a population in the economically developed countries will during their lifetime suffer from a disease mainly as the result of their genetic constitution. Adding to that, it is estimated that all diseases have a genetic component, which will determine who will be at a higher than average risk for a certain disorder. Further it is postulated that in the near future, this genetic profiling could become useful in selecting an appropriate therapy adapted to the genetic constitution of the person. Thus, genetic disorders are not rare. Measuring quality of health care related processes became an issue in the 1990s, mainly in laboratory medicine, but also for hospitals and other health care systems. In many countries national authorities started to implement recommendations, guidelines or legal procedures regulating quality of health care delivery. In laboratory medicine, in parallel, the use of accreditation as a method assuring high quality standards in testing came in use. With the increasing possibilities of performing molecular genetic testing, genetic laboratories needed to become involved in this process. As many genetic disorders are rare, most laboratories worldwide offered analysis for a specific set of disorders, and, therefore, very early on a transborder flow of samples occurred. While international quality criteria (ISO) have been in existence for a number of years, the regulation of quality issues still may differ between countries. Based on their personal experience in the varying fields of quality research and clinical implementation of quality criteria in genetic services the authors of this book share their experience and give examples of the implementation of quality issues in national quality systems worldwide. This book, which is the result of the effort of many persons, is destined to aid laboratory managers and counsellors, health care managers and other stakeholders in national or international health care service to improve the services to the benefit of patients with suspected genetic disorders.

This book examines the impact and shortcomings of the TRIPS Agreement, which was signed in Marrakesh on 15 April 1994. Over the last 20 years, the framework conditions have changed fundamentally. New technologies have emerged, markets have expanded beyond national borders, some developing states have become global players, the terms of international competition have changed, and the intellectual property system faces increasing friction with public policies. The contributions to this book inquire into whether the TRIPS Agreement should still be seen only as part of an international trade regulation, or whether it needs to be understood – or even reconceptualized – as a framework regulation for the international protection of intellectual property. The purpose, therefore, is not to define the terms of an outright revision of the TRIPS Agreement but rather to discuss the framework conditions for an interpretative evolution that could make the Agreement better suited to the expectations and needs of today’s global economy.

Unter Evergreening werden in Bezug auf Arzneimittelerfindungen solche Patentierungsstrategien verstanden, mit welchen Arzneimittelhersteller den Patentschutz eines Ausgangswirkstoffes durch die Entwicklung von Derivaten faktisch verlängern. Es handelt sich oft um Variationen bereits patentierter Arzneimittel, die erst gegen Ende der Laufzeit der Ausgangserfindung angemeldet werden. Der indische Gesetzgeber hat sich – im Gegenzug zu der Verpflichtung aus dem TRIPS-Übereinkommen, den Schutz von Stofferfindungen einzuführen – für eine Regelung entschieden, nach der Weiterentwicklungen mit geringem Innovationswert vom Patentschutz ausgeschlossen sein können. Die Arbeit vergleicht die Auslegung der Patentfähigkeitsvoraussetzungen auf Grundlage des PatG, des EPÜ und des indischen Patents Act, nimmt zur Diskussion über die TRIPS-Vereinbarkeit der indischen Regelungen Stellung und analysiert die Gründe für die Wahl des jeweiligen Regelungskontextes für Preiskontrollen im Gesundheitssektor.
