This book examines how Israeli land policy today inhibits access to land for its own Arab citizens even within the 1948 boundaries of the state of Israel. Its authors explore the system of land ownership, the acquisition and administration of public land, and the control of land use through planning and housing regulations. They argue that the law is used to discriminate against non-Jewish citizens and restrict Israeli Palestinians' access to land, and that Israeli land policies breach international human rights standards which could be used as a basis to challenge discriminatory policies.

Circles Of Exclusion written by Dani Filc and has been published by Cornell University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-03-15 with History categories.

In its early years, Israel's dominant ideology led to public provision of health care for all Jewish citizens-regardless of their age, income, or ability to pay. However, the system has shifted in recent decades, becoming increasingly privatized and market-based. In a familiar paradox, the wealthy, the young, and the healthy have relatively easy access to health care, and the poor, the old, and the very sick confront increasing obstacles to medical treatment. In Circles of Exclusion, Dani Filc, both a physician and a human rights activist, forcefully argues that in present-day Israel, equal access to health care is constantly and systematically thwarted by a regime that does not extend an equal level of commitment to the well-being of all residents of Israel, whether Jewish, Israeli Palestinians, migrant workers, or Palestinians in the Occupied Territories. Filc explores how Israel's adoption of a neoliberal model has pushed the system in a direction that gives priority to the strongest and richest individuals and groups over the needs of society as a whole, and to profit and competition over care.Filc pays special attention to the repercussions of policies that define citizenship in a way that has serious consequences for the health of groups of Palestinians who are Israeli citizens-particularly the Bedouins in the unrecognized villages-and to the ways in which this structure of citizenship affects the health of migrant workers. The health care situation is even more dire in the Occupied Territories, where the Occupation, especially in the last two decades, has negatively affected access to medical care and the health of Palestinians. Filc concludes his book with a discussion of how human rights, public health, and economic imperatives can be combined to produce a truly equal health care system that provides high-quality services to all Israelis.

"For years, Israeli authorities have both barred Palestinian access to rings of land surrounding settlements, and have not acted to eliminate settlers' piratical closing of lands adjacent to settlements and blocking Palestinian access to them. Denying access is one of the many ways used to expand settlements. In recent years, Israel has institutionalized the closing of such lands in an attempt to retroactively sanction the unauthorized placement of barriers far from the houses at the edge of the settlements. Denying Palestinian access to lands adjacent to settlements is the direct result, and an integral part, of the illegal settlement enterprise. This enterprise continuously violates the absolute prohibition specified in international humanitarian law on settlements in occupied territory. This prohibition obliges Israel to evacuate the settlers and return them to sovereign Israeli soil"--Publisher.

Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to the law applied to cases involving cross border issues in Israel. It offers every lawyer dealing with questions of conflict of laws much-needed access to these conflict rules, presented clearly and concisely by a local expert. Beginning with a general introduction, the monograph goes on to discuss the choice of law technique, sources of private international law, and the relevant connection with other laws. Then follows clear description and analysis of the rules of choice of law on natural and legal persons, contractual and non-contractual obligations, movable and immovable property, intangible property rights, company law, family law (marriage, cohabitation, registered partnerships, matrimonial property, maintenance, child law), and succession law (including testamentary dispositions). The presentation concludes with an overview of relevant civil procedure, examining lex fori and issues of national and international jurisdiction, acceptability and enforcement of foreign judgements, and international arbitration. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling cases in Israel. Academics and researchers, as well as judges, notaries public, marriage registrars, youth welfare officers, teachers, students, and local and public authorities will welcome this very useful guide, and will appreciate its value in the study of private international law from a comparative perspective.

Whither Jerusalem written by Deborah Housen-Couriel and has been published by BRILL this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-12-04 with Political Science categories.

The future of Jerusalem is the most difficult issue facing negotiators, political and legal experts. In the current peace talks between Israel and its neighbours, it has been agreed to postpone discussion on Jerusalem to the latest stage of the peace process. But the Jerusalem question continues to come to the fore at every turn, always charged with intensely emotional and uncompromising statements: not only from those parties who are directly involved, but also by eminent personalities, organizations and states elsewhere. The Jerusalem Institute for Israel Studies has collected 55 proposals: 12 were written between 1916-1950 and 43 between 1967-1993. Their authors, coming from various countries, present various approaches to the three main issues at stake: sovereignty, holy places, and municipal governance. Whither Jerusalem? summarizes each of the 55 proposals, gives brief information about their authors, and analyzes the similarities and divergences between them. The official position of five states and organizations is included, as well as a lexicon of terms used by the authors of the proposals.
