Claims to land and territory are often a cause of conflict, and land issues present some of the most contentious problems for post-conflict peacebuilding. Among the land-related problems that emerge during and after conflict are the exploitation of land-based resources in the absence of authority, the disintegration of property rights and institutions, the territorial effect of battlefield gains and losses, and population displacement. In the wake of violent conflict, reconstitution of a viable land-rights system is crucial: an effective post-conflict land policy can foster economic recovery, help restore the rule of law, and strengthen political stability. But the reestablishment of land ownership, land use, and access rights for individuals and communities is often complicated and problematic, and poor land policies can lead to renewed tensions. In twenty-one chapters by twenty-five authors, this book considers experiences with, and approaches to, post-conflict land issues in seventeen countries and in varied social and geographic settings. Highlighting key concepts that are important for understanding how to address land rights in the wake of armed conflict, the book provides a theoretical and practical framework for policy makers, researchers, practitioners, and students. Land and Post-Conflict Peacebuilding is part of a global initiative to identify and analyze lessons in post-conflict peacebuilding and natural resource management. The project has generated six edited books of case studies and analyses, with contributions from practitioners, policy makers, and researchers. Agricultural Land Redistribution and Land Administration in Sub-Saharan Africa: Case Studies of Recent Reforms focuses on “how” to undertake land reforms in Sub-Saharan Africa, but with relevant lessons for other developing countries. It provides details, with case studies, on how reforms were undertaken to address a pressing and controversial development challenge in Africa – land ownership inequality – and an intransigent development issue – inefficiency and corruption in land administration. An equally important contribution of the book is assessing reforms and highlighting valuable lessons for other countries contemplating reforms. The six case studies collectively cover two main areas of land governance: reforms in redistributing agricultural land and reforms in land administration. The first two case studies discuss reforms in redistributing agricultural land in Malawi and South Africa, part of the southern Africa region where land ownership inequalities rival those in Latin America. The remaining case studies, four in number, are focused on addressing corruption and inefficiency in land administration in a variety of contexts of governance including stable and post-conflict countries. The case studies cover: • Decentralizing land administration with demonstrations from Uganda, Ethiopia, Tanzania, and Ghana; • Developing post-conflict land administration systems with examples from Liberia and Rwanda; • Re-engineering and computerizing land information systems with examples from Ghana and Uganda; and • Improving management of government land through land inventories with examples drawn from Ghana and Uganda. The common elements between sometimes disparate experiences provide lessons of relevance to African and other developing countries contemplating similar reforms. The rigorous analysis and yet down-to-earth lessons of experience are a reflection of the authors’ deep global experience underpinned by personal participation in the reforms covered by the book. While there is a large, though inconclusive, literature on the impact of land titles in Africa, little attention has been devoted to the study of land conflict, despite evidence on increasing incidence of such conflicts. Deininger and Castagnini use data from Uganda to explore who is affected by land conflicts, whether recent legal changes have helped to reduce their incidence, and to assess their impact on productivity. Results indicate that female-headed households and widows are particularly affected and that the passage of the 1998 Land Act has failed to reduce the number of pending land conflicts. The authors also find evidence of a significant and quantitatively large productivity-reducing impact of land conflicts. This suggests that, especially in Africa, attention to land-related conflicts and exploration of ways to prevent and speedily resolve them would be an important area for policy as well as research. This paper--a product of Rural Development, Development Research Group--is part of a larger effort in the group to explore the impact of land policies.

This collection clarifies the background of land and property problems in conflict-affected settings, and explores appropriate policy measures for peace-building. While land and property problems exist in any society, they can be particularly exacerbated in conflict-affected settings – characterized by unstable security, weak governance, loss of proper documentation as well as the return of refugees and Internally Displaced Persons. Unless these problems are properly addressed, they can destabilize fragile political order and hinder economic recovery. Although tackling land and property problems is an important challenge for peace-building, it has been relatively neglected in recent debates about liberal peace-building as a result of the strong focus on state-level institution building, such as security sector reforms and transitional justice. Using rich original data from eight conflict-affected countries, this book examines the topic from the viewpoint of State-society relationship. In contrast to previous literature, this volume analyses land and property problems in conflict-afflicted areas from a long-term perspective of state-building and economic development, rather than concentrating only on the immediate aftermath of the conflict. The long-term perspective enables not only an understanding of the root causes of the property problems in conflict-affected countries, but also elaboration of effective policy measures for peace. Contributors are area specialists and the eight case study countries have been carefully selected for comparative study. The collection applies a common framework to a diverse group of countries – South Sudan, Uganda, Rwanda, Burundi, Cambodia, Timor-Leste, Colombia, and Bosnia-Herzegovina.
