Constitutionalism has become a byword for legitimate government, but is it fated to lose its relevance as constitutional states relinquish power to international institutions? This book evaluates the extent to which constitutionalism, as an empirical idea and normative ideal, can be adapted to institutions beyond the state by surveying the sophisticated legal and political system of the European Union. Having originated in a series of agreements between states, the EU has acquired important constitutional features like judicial review, protections for individual rights, and a hierarchy of norms. The executive branch of government in Europe is being gradually transformed in several significant respects. First, executive power has been continuously strengthened at the EU level in the form of the European Commission, EU-level agencies and diplomatic and military staff in the Union Council secretariat. Second, EU executive bodies relate directly to (regulatory) authorities at the national level in charge of applying (and partly preparing) EU laws and programmes, partly circumventing ministerial departments. Thus, parts of national administrations become parts of an integrated and multi-level Union administration as well as parts of national executives. Such a system with multiple political masters raises delicate questions about political steering and accountability. This book focuses on this fascinating development both from a political science and a legal perspective, encompassing the consolidation of the supranational executive as well as its relationships with its ‘partners’ at the national level. The debate on law, governance and constitutionalism beyond the state is confronted with new challenges. In the EU, confidence in democratic transnational governance has been shaken by the authoritarian and unsocial practices of crisis management. The ambition of this book, which builds upon many years of close co-operation between its contributors, is to promote a viable interdisciplinary alternative to these developments. “Conflicts-law constitutionalism” is a concept of transnational governance which derives democratic legitimacy from the supranational control of the external impact of national decision-making, on the one hand, and the co-operative responses to problem interdependencies on the other. The first section of the book contrasts Europe's new modes of economic governance and crisis management with the conditionality of international investments, and reflects upon the communalities and differences between emergency Europe and global exceptionalism.
