This book, by the author of The American Common Law Method, is an excellent source of continuing judicial education for judges at all levels as well as an accessible teaching tool for the classroom. An opening section explains the basic principles of common law methods for creating and applying case law. Advanced Case Law Method then examines the methods used by appellate courts in four states to create case lines on distinct topics. After each case in each line, the author poses several questions concerning the court's performance as a creator and user of case law. For instance, one chapter traces the "at will" employment doctrine as developed by the New York Court of Appeals and subsequent efforts to create public policy exceptions to the rule. Another looks at the struggle of the appellate courts of Pennsylvania to limit the "intentional infliction of emotional distress" tort doctrine. The New Hampshire group of cases goes back to the mid-18th century and examines railroad liability issues, culminating in the 21st century with duties imposed on internet information providers when the buyer of information causes harm to the seller. The Texas cases treat the "spoliation" doctrine which penalizes a party responsible for causing key evidence to disappear. Following the questions raised by the examined cases, Advanced Case Law Methods includes the suggested responses. The text is then supplemented by a section intended to make the questions and suggested responses a springboard for discussion at seminars, conferences and even classrooms. Judges, therefore, won't have to worry about "doing homework" and getting wrong answers. Published under the Transnational Publishers imprint.

This book is a tight and fresh analysis of the American legal profession and its significance to society and its citizens. The book’s primary objective is to expose, and correct, the principal misconceptions - myths - surrounding prelaw study, law school admission, law school, and the American legal profession itself. These issues are vitally important to prelaw advisors and instructors in light of the difficult problems caused by the Great Recessions of 2008 and 2020-2021 and the disruptions caused by the COVID-19 pandemic. Aimed equally at prelaw advisors and potential law students, this book can be used as a supplement in the interdisciplinary undergraduate law-related instructional market, including courses that cater to majors/minors in political science and criminal justice in particular. It can also be used in career counselling, internships, and the extensive paralegal program market. New to the Second Edition Expanded coverage to include paralegal and legal assistant training New material on women and minority law students who are transforming law schools and the profession Explores challenges to the legal profession posed by economic recession, COVID-19, high tuition rates, exploding student loan debt, internet technological advances, and global competitive pressures, including legal outsourcing and DIY legal services Updated data and tables along with all underlying research

This book adopts a transnational methodology to reflect on the legalisation of international economic relations. A Liber Amicorum for Professor Francis Snyder, it outlines the ways in which legal scholarship has taken his legacy further in relation to the concept of transnational law, the 'law in context' method, and the evolution of sustainability law. The lens is both theoretical and practical, delving into international investment law, financial/monetary law, free trade agreements, indigenous rights, and food law, and covering case studies from EU law, WTO law, American law, Chinese law, and Indonesian law. The chapters explore how Snyder's ideas have advanced legal research and determined change in regulation, impacting trade relationships worldwide. Part I of the book gives an overview of the actors, the norms, and the processes of transnational economic law, discussing sites of governance, legal pluralism, and soft law. Part II takes stock of the 'law in context' research method, looking not only at the way in which it can be refined and used by academics, but also at the practical implications of such a method to improve regulatory settings and promote social and policy goals (including the emerging generation of FTAs, such as TPP, TTIP, and RCEP). Part III focuses on sustainability law, assessing Francis Snyder's contribution to systemic changes and reforms in China and the Asia Pacific region. The book is a must have for any academic or practitioner interested in an up-to-date account of the recent developments in transnational trade law research.
