Este estudio tuvo como objetivo analizar la aplicabilidad de los derechos humanos y la legislación a través de la responsabilidad del Estado con relación a las agresiones sufridas por los imputados en el sistema penitenciario; además de conocer los derechos de los imputados dentro del sistema penitenciario; demostrar las legislaciones que pretende proteger al imputado mientras se encuentra en prisión y su aplicabilidad y protección a los mismos, pues se sabe que el sistema penitenciario ha venido demostrando ser un ambiente de violación de los derechos humanos, no permitiendo que la función humanística primaria de la pena se cumpla correctamente, aunque esté garantizada en la Constitución Federal de 1988. Debe haber algún medio que pueda hacer cumplir los requisitos legales, compatibilizando la estructura con los estándares nacionales e internacionales exigidos por los órganos de protección de los derechos humanos, brindando apoyo social y psicológico al imputado que se encuentra en las cárceles, ya que cada vez más se habla de agresión. y la tortura dentro de estos lugares. Lo que se puede apreciar es que el proceso de encarcelamiento se ha venido reflejando en la sociedad carcelaria de manera brutal, generando en esta población un sentimiento de inseguridad, especialmente de los órganos que deben protegerlos. Este estudio se trata de una investigación bibliográfica, con carácter descriptivo y enfoque exploratorio, donde se concluye que la falla del sistema penitenciario brasileño es una realidad que se ha vinculado a lo largo de los años, contribuyendo a la violación de garantías y derechos fundamentales de aquellos que se encuentran privados de libertad, bajo la tutela del Estado, pues los derechos de la Ley de Ejecución Penal no se aplican en la práctica, lo que hace que la pena de prisión fracase en cuanto a la resocialización del privado de libertad, hasta porque no hay que hablar de resocialización en un ambiente marcado por la hostilidad y la violencia. Son constantes los relatos relacionados a la práctica de torturas y maltratos en unidades de privación de libertad, siendo que la mayoría de esas prácticas de torturas y maltratos permanecen ocultas. Así, el problema de la relación entre la violencia y la tortura en prisión es un factor complejo, que se ha agravado con la práctica del encarcelamiento como forma de control social. Deben generarse políticas públicas dirigidas a combatir efectivamente la criminalidad, asegurando los derechos fundamentales y garantías previstas en la legislación.

The modern prison is commonly thought to be the fruit of an Enlightenment penology that stressed man's ability to reform his soul. The Medieval Prison challenges this view by tracing the institution's emergence to a much earlier period beginning in the late thirteenth century, and in doing so provides a unique view of medieval prison life. G. Geltner carefully reconstructs life inside the walls of prisons in medieval Venice, Florence, Bologna, and elsewhere in Europe. He argues that many enduring features of the modern prison--including administration, finance, and the classification of inmates--were already developed by the end of the fourteenth century, and that incarceration as a formal punishment was far more widespread in this period than is often realized. Geltner likewise shows that inmates in medieval prisons, unlike their modern counterparts, enjoyed frequent contact with society at large. The prison typically stood in the heart of the medieval city, and inmates were not locked away but, rather, subjected to a more coercive version of ordinary life. Geltner explores every facet of this remarkable prison experience--from the terror of an inmate's arrest to the moment of his release, escape, or death--and the ways it was viewed by contemporary observers.
