Al-Ahkam as-Sulthaniyyah ini merupakan karya monumental al-Mawardi yang kuat diyakini ditulis atas permintaan Khalifah al-Qa’im bi Amrillah (422–467 H). Buku ini memuat hukum-hukum yang sangat dibutuhkan oleh para penguasa, khususnya khalifah dan jajarannya. Selain dibutuhkan oleh aparatur pemerintah sebagai rujukan untuk menjalankan tugas dan kewajiban mereka, juga menjadi pegangan masyarakat untuk mengetahui hak dan kewajiban para penguasa atas diri mereka. Dengan begitu, mereka mempunyai pedoman untuk melakukan check and balance. Buku ini terdiri dari dua puluh bab, dan membahas banyak hal, seperti: akad Imamah, pengangkatan Wizarat (pembantu khalifah), bukan wizarat dengan konotasi kementerian seperti dalam sistem demokrasi, pengangkatan Imarah ‘ala al-Bilad (kepala daerah), pengangkatan Imarah ‘ala al-Jihad (panglima perang), dan sebagainya. Termasuk bab tentang penetapan Jizyah dan Kharaj, hukum Ihya’ al-Mawat (menghidupkan tanah mati), eksplorasi air (termasuk tambang), Hima dan Irfaq (proteksi lahan dan kepemilikan umum), hingga Diwan (administrasi), Ahkam al-Jara’im (hukum tindak kriminal), dan Hisbah. Menariknya, dalam buku ini al-Mawardi sama sekali tidak terpengaruh oleh teori-teori Socrates, Plato, Aristoteles atau filsuf Yunani lainnya. Padahal, ketika itu pemikiran mereka sudah diterjemahkan ke dalam bahasa Arab. Dalam penulisannya, beliau berpijak pada al-Qur’an, as-Sunnah, ijma’ dan qiyas sebagaimana dalil yang lazim digunakan di kalangan mazhab Syafi’i. Selain itu, beliau juga menjelaskan berbagai pandangan mazhab yang berkaitan dengan sistem pemerintahan Islam ini. Istimewanya lagi, buku Al-Ahkam as-Sulthaniyyah ini menjadi rujukan penting karena selain penulisnya yang merupakan seorang mujtahid, juga adalah pelaku sejarah.
