The inspiring idea of this workshop series, Artificial Intelligence Approaches to the Complexity of Legal Systems (AICOL), is to develop models of legal knowledge concerning organization, structure, and content in order to promote mutual understanding and communication between different systems and cultures. Complexity and complex systems describe recent developments in AI and law, legal theory, argumentation, the Semantic Web, and multi-agent systems. Multisystem and multilingual ontologies provide an important opportunity to integrate different trends of research in AI and law, including comparative legal studies. Complexity theory, graph theory, game theory, and any other contributions from the mathematical disciplines can help both to formalize the dynamics of legal systems and to capture relations among norms. Cognitive science can help the modeling of legal ontology by taking into account not only the formal features of law but also social behaviour, psychology, and cultural factors. This book is thus meant to support scholars in different areas of science in sharing knowledge and methodological approaches. This volume collects the contributions to the workshop's third edition, which took place as part of the 25th IVR congress of Philosophy of Law and Social Philosophy, held in Frankfurt, Germany, in August 2011. This volume comprises six main parts devoted to the each of the six topics addressed in the workshop, namely: models for the legal system ethics and the regulation of ICT, legal knowledge management, legal information for open access, software agent systems in the legal domain, as well as legal language and legal ontology.

The book presents observations concerning automated decision-making from a general point of view at the same time as it analyses the manner in which praxis in some jurisdictions has evolved as concerns automated decision-making and how the requirements that are placed by the legal orders on it are formulated. The principle of the rule of law should apply in the context of automated decision-making of public authorities just as much as when the decision-makers are physical persons. In sync with increasing automatization of decision-making in public authorities, problematizing questions about the appropriate legal basis for algorithmic decision-making have started emerge. How should the principle of the rule of law apply within the area of automated decision-making, how should automated decision-making be regulated so that it satisfies the requirements created by the principle of the rule of law, and how should the principle of the rule of law be made concrete in decision-making that is based on algorithms? The proposal for an AI Act launched by the European Commission in April 2021, including an identification of high-risk uses of algorithmic techniques, raises further questions concerning practices and interpretations related to automated decision-making. The state based on the rule of law proceeds from the maxim that public powers are exercised within a legal frame that makes the exercise of public powers foreseeable in light of legal norms. Also, a state based on the rule of law requires that the contents of the exercise of public powers is regulated by legal norms, which means that the citizens must be able to know everything that is relevant about how the powers will be exercised, not only who it is that will exercise the powers. Because of rules and principles of this kind, including non-discrimination and proportionality, the exercise of powers will not become arbitrary.

This book presents a model-driven approach for creating a national application profile of the international legislative document standard Akoma Ntoso (AKN). AKN is an XML-based document standard that serves as the basis for modern machine-readable and fully digital legislative and judicial processes. The described model-driven development approach ensures consistent and error-proof application of AKN concepts and types, even when using different software tools. It allows for easy maintenance, is self-documenting, and facilitates stakeholder validation with nontechnical legal experts. The resulting application profile remains fully compliant to and compatible with AKN. For the sake of illustration, the approach is paradigmatically applied to the German federal legislative process, as a corresponding approach was used in the creation of the German AKN application profile, LegalDocML.de. We discuss how the methodology yields a model, schema definition and specification that correspond to the artefacts created by LegalDocML.de, using examples from Germany. The book is of interest to both legal and technical project teams on the cusp of introducing AKN in a legislative domain and intended as a practical guideline for teams preparing to create a custom application profile for their own domain. Furthermore, it can serve as both a resource and an inspiration for similar and yet to be developed methodologies in the public sector, the health sector or in defense, where international standardization and interoperability efforts are to be applied to a local level.
