Air Quality State Implementation Plans - Approvals and Promulgations - Fine Particulate Matter National Ambient Air Quality Standards (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals and Promulgations - Fine Particulate Matter National Ambient Air Quality Standards (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is finalizing requirements that state, local and tribal air agencies would have to meet as they implement the current and future national ambient air quality standards (NAAQS) for fine particulate matter (PM 2.5). Specifically, this document provides details on meeting the statutory state implementation plan (SIP) requirements that apply to areas designated nonattainment for any PM 2.5 NAAQS, such as: General requirements for attainment plan due dates and attainment dates; emissions inventories; attainment demonstrations; provisions for demonstrating reasonable further progress; quantitative milestones; contingency measures; and nonattainment New Source Review (NNSR) permitting programs, among other things. This rule clarifies the specific attainment planning requirements that apply to PM 2.5 NAAQS nonattainment areas based on their classification (either Moderate or Serious), and the process for reclassifying Moderate areas to Serious. Additionally, in this document the EPA is revoking the 1997 primary annual standard for areas designated as attainment for that standard because the EPA revised the primary annual standard in 2012. The EPA first established the PM 2.5 NAAQS in 1997, completed a review and revision of those standards in 2006, and most recently completed a review and revision of the PM 2.5 NAAQS on December 14, 2012. Air Quality State Implementation Plans - Approvals and Promulgations - California - Infrastructure Requirements for Ozone (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals and Promulgations - California - Infrastructure Requirements for Ozone (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is partially approving and partially disapproving several State Implementation Plan (SIP) revisions submitted by the State of California pursuant to the requirements of the Clean Air Act (CAA or the Act) for the implementation, maintenance, and enforcement of national ambient air quality standards (NAAQS) for ozone, fine particulate patter (PM 2.5), lead (Pb), nitrogen dioxide (NO 2), and sulfur dioxide (SO 2). We refer to such SIP revisions as "infrastructure" SIPs because they are intended to address basic structural SIP requirements for new or revised NAAQS including, but not limited to, legal authority, regulatory structure, resources, permit programs, and monitoring necessary to assure attainment and maintenance of the standards. In addition, we are reclassifying certain regions of the state for emergency episode planning purposes with respect to ozone, NO 2, SO 2, and particulate matter (PM). Finally, we are approving into the California SIP several state provisions addressing CAA conflict of interest requirements and an emergency episode planning rule for Great Basin Unified Air Pollution Control District for PM. Air Quality State Implementation Plans - Approvals and Promulgations - Wyoming - Interstate Transport (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals and Promulgations - Wyoming - Interstate Transport (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is taking final action on portions of six submissions from the state of Wyoming that are intended to demonstrate that the State Implementation Plan (SIP) meets certain interstate transport requirements of the Clean Air Act (Act or CAA). These submissions address the 2006 and 2012 fine particulate matter (PM 2.5) National Ambient Air Quality Standards (NAAQS), 2008 ozone NAAQS, 2008 lead (Pb) NAAQS, 2010 sulfur dioxide (SO 2) NAAQS and 2010 nitrogen dioxide (NO 2) NAAQS. The interstate transport requirements under the CAA consist of four elements (or prongs): Significant contribution to nonattainment (prong 1) and interference with maintenance (prong 2) of the NAAQS in other states; and interference with measures required to be included in the plan for other states to prevent significant deterioration of air quality (prong 3) or to protect visibility (prong 4). Specifically, the EPA is approving Wyoming's submissions for interstate transport prongs 1 and 2 for the 2008 Pb and 2010 NO 2 NAAQS, and approving prong 1 and disapproving prong 2 for the 2008 ozone NAAQS. The EPA is also approving interstate transport prong 4 for the 2008 Pb and 2010 SO 2 NAAQS, and disapproving prong 4 for the 2006 PM 2.5, 2008 ozone, 2010 NO 2 and 2012 PM 2.5 NAAQS. Air Quality State Implementation Plans - Approvals and Promulgations - Texas - Revision of Federal Implementation Plan Requirements (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals and Promulgations - Texas - Revision of Federal Implementation Plan Requirements (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is finalizing withdrawal of the federal implementation plan (FIP) provisions that require affected electricity generating units (EGUs) in Texas to participate in Phase 2 of the Cross-State Air Pollution Rule (CSAPR) trading programs for annual emissions of sulfur dioxide (SO 2) and nitrogen oxides (NO X). Withdrawal of the FIP requirements is intended to address a decision of the U.S. Court of Appeals for the District of Columbia Circuit (D.C. Circuit) remanding the CSAPR Phase 2 SO 2 budget for Texas to the EPA for reconsideration. With this action, the EPA is also determining that, following withdrawal of the FIP requirements, sources in Texas do not contribute significantly to nonattainment in, or interfere with maintenance by, any other state with regard to the 1997 national ambient air quality standard (NAAQS) for fine particulate matter (PM 2.5). Accordingly, we are also determining that the EPA has no obligation to issue new FIP requirements for Texas sources to address transported PM 2.5 pollution under Clean Air Act (CAA) section 110(a)(2)(D)(i)(I) with regard to that NAAQS. Finally, the EPA is also affirming the continued validity of the Agency's 2012 determination that participation in CSAPR meets the Regional Haze Rule's criteria for an alternative to the application of source-specific best available retrofit technology (BART). The EPA has determined that changes to CSAPR's geographic scope resulting from the actions EPA has taken or expects to take in response to the D.C. Circuit's remand do not affect the continued validity of participation in CSAPR as a BART alternative, because the changes in geographic scope would not have adversely affected the results of the air quality modeling analysis upon which the EPA based the 2012 determination. Air Quality State Implementation Plans - Approvals and Promulgations - Oregon - Permitting and General Rule Revisions (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals and Promulgations - Oregon - Permitting and General Rule Revisions (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is approving, and incorporating by reference, changes to Oregon's State Implementation Plan (SIP) submitted on April 22, 2015. The changes relate to the criteria pollutants for which the EPA has established national ambient air quality standards-carbon monoxide, lead, nitrogen dioxide, ozone, particulate matter, and sulfur dioxide. Specifically, the changes account for new federal requirements for fine particulate matter, update the major and minor source pre-construction permitting programs, and add state-level air quality designations. The changes also address public notice procedures for informational meetings, and tighten emission standards for dust and smoke. In addition, Oregon reorganized rules in the SIP by consolidating definitions, removing duplicate provisions, correcting errors, and removing outdated provisions.
