Inhaltsangabe:Introduction: In 1985 Thomas Zwirner of HSBC Trinkaus invented the Discount Certificate by copying an investment strategy of professional investors. Now there are over 100,000 certificates traded on the European Warrant Exchange (EUWAX). About 80% are discount certificates. Many Banks promote discount certificates as a safer and more profitable investment than a direct investment in stocks. However, when Lehman Brothers has filed bankruptcy in 2008 many investors lost their money invested in Lehman certificates. Investors may now ask themselves the question if certificates and especially discount certificates are a true alternative to a stock investment. The following work will answer this question. It is structured as follows: Chapter 2 describes basic information about discount certificates; it also provides information on the markets for discount certificates. Chapter 3 will identify and evaluate the risks and opportunities of a direct stock investment and a investment in discount certifi-cates. Chapter 4 evaluates the behavior of discount certificates and stocks in differ-ent market scenarios by using a fictive example. In chapter 5 possible strategies for an investment in discount certificates are given by the author and evaluated on their risk and opportunities, while chapter 6 concludes. Since there are many different types of discount certificates, this work will focus on the discount certificates with an underlying of one share of the respective company. This study of the boundaries of personal property has an inward and an outward perspective, with the intellectual emphasis on the latter. The inward-looking inquiry considers shares as items of personal property. Nowadays those who think of themselves as shareholders often stand one step removed from the share itself. They hold what this book christens a sub-share. This part of the book asks in what sense shares and sub-shares can be conceived to be things, how those things are alienated, and how they are protected in litigation. The outward-looking inquiry then asks whether personal property can be contemplated as a sub-category of the law of things and, more particularly, as the law of all things locatable in space, alienable, or vindicable in court. The outward inquiry considers three boundaries. Within the law of property the line between realty and personalty proves relatively uncontroversial; the second boundary lies between property and obligations; the third between wealth and non-wealth. The second boundary is the main concern. Respect for it necessitates a differentiation between the law of property in the strict sense and the all-encompassing law of wealth, even where the consequence might be to exclude shares and sub-shares from the law of property. In maintaining the value of careful proprietary taxonomy and in reviving the underlying concepts on which it depends, this book opposes modern scepticism as to the possibility and desirability of precision in legal classification. In these commitments it could fairly be styled a post-modern study of personal property. Winner of the SLS Birks Prize for Outstanding Legal Scholarship 2006 - Second Prize.

In der vorliegenden Untersuchung werden die Ergebnisse einer Forschungs arbeit veröffentlicht, deren Ziel war, absolutes Neuland zu erschließen. Wieder holt bin ich von beachtlicher Seite der Unternehmerschaft, wie auch von besten Kennern der Handelskammern, so Herrn Dr. Waldemar Ringleb, aufgefordert worden, doch Forschungsarbeiten in Gang zu setzen, die zwar nicht unbedingt konkreten Nutzen versprechen, deren Durchführung aber nötig ist, damit für den Fall des Bedarfs wissenschaftlich das Material vorbereitet ist, welches von der Praxis aus nicht erstellt werden kann. Ich habe solchen Ratschlägen um so lieber Folge geleistet, als mir eine derartige prospektierende Tätigkeit selbst liegt, so daß ich vielleicht eine Empfindung dafür habe, mir jüngere Mitarbeiter heranzuholen, die ähnliche Neigungen aufweisen. Es drehte sich einmal darum, gewisse Einseitigkeiten unserer Börsenentwicklung auf lange Sicht zu korri gieren, dann darum, die beträchtlichen Benachteiligungen der mittleren und kleineren Gewerbebetriebe in der Kapital-und Kreditversorgung einer besse ren Lösung entgegenzuführen, weiter eine größere Vielfalt von zweckmäßigen Kapitalanlagen anzubieten und schließlich der uns in unserem Lande auf lange Frist drohenden Überbetonung des langfristigen Kredits gerade bei den Ge schäftsbanken zu entgehen, die uns, wenn sie sich durchsetzen sollte, langfristig vor ernste Liquiditätsfragen stellen würde, weil man mit kurzfristigen Ein lagen schwer Dauerkredite geben kann. Die Lösung muß also darin gesehen werden, daß gewisse Teile der Bankeinlagen lieber direkt in Industriekredite überführt werden, und zwar unter Anbringung einer zweckmäßigen Risiko verteilung, d. h. von Sicherungsmaßnahmen, so daß zumindest eine Verlang samung des Prozesses der Verlängerung der Bankbilanzen eintreten könnte.
