Bracketed Belonging addresses how nations and their governance of security determine social constellations and shape socio-political and legal assertions of belonging and allegiance. Kelvin E. Y. Low examines the contours and limits of belonging that underlie the complex social contract between mobile migrants and nations in the context of a global military-security market. He explores these core themes through the case of Nepali Gurkhas and their families as military and paramilitary migrants. Recruited to serve in the military or police force, Gurkhas are trained in jungle warfare skills that other police groups do not possess. There is thus the professional link to military training and the formation of a unique paramilitary police force with the backdrop of colonialism. In these contexts, this book offers fresh perspectives on studying global security, migration and diasporic lives. It sets a new agenda by analytically bridging empire, military and security maneuvers, and migratory pathways and options. Part I focuses on the ways in which cosmopolitan characters are represented in selected novels, from the debauched Anthony Blanche in Evelyn Waugh’s classic Brideshead Revisited, to the victimized Ila in Amitav Ghosh’s The Shadow Lines, to John le Carré’s undefinable spies. Part II focuses on self-representations of people with a cosmopolitan upbringing, in the form of autobiographical narratives by well-known authors such as Barack Obama and Edward Said, along with lesser-known writers, all of whom “write back” to the ways in which they have at times been stereotyped and othered in literary fiction and public discourse.

This book explores the use of foreign judges on courts of constitutional jurisdiction in 9 Pacific states: Fiji, Kiribati, Nauru, Papua New Guinea, Samoa, Solomon Islands, Tonga, Tuvalu and Vanuatu. We often assume that the judges sitting on domestic courts will be citizens. However across the island states of the Pacific, over three-quarters of all judges are foreign judges who regularly hear cases of constitutional, legal and social importance. This has implications for constitutional adjudication, judicial independence and the representative qualities of judges and judiciaries. Drawing together detailed empirical research, legal analysis and constitutional theory, it traces how foreign judges bring different dimensions of knowledge to bear on adjudication, face distinctive burdens on their independence, and hold only an attenuated connection to the state and its people. It shows how foreign judges have come to be understood as representatives of a transnational profession, with its own transferrable judicial skills and values. Foreign Judges in the Pacific sheds light on the widespread but often unarticulated assumptions about the significance of nationality to the functions and qualities of constitutional judges.
