Offshore-Windparkprojekte sind in besonderem Maße konfliktanfällig. Um Konflikte bereits projektbegleitend beizulegen, werden meistens Dispute Boards vereinbart. Während Dispute Boards international erfolgreich eingesetzt werden, laufen die Dispute-Board-Verfahren bei deutschen Offshore-Windparks häufig nicht reibungslos. So existiert eine projektbegleitende Streitbeilegung oft nicht, weil die Ernennung des Dispute Boards zu spät erfolgt und zu lange dauert. Zudem schrecken die Parteien vor der Einleitung eines Dispute-Board-Verfahrens zurück, weil sie den Projektfrieden nicht durch eine Verfahrenseinleitung gefährden wollen und die Verfahren für die projektbegleitende Durchführung zu arbeitsintensiv sind. In der Folge können Dispute Boards nicht verhindern, dass Claims gesammelt werden. Die Verfasserin untersucht die Ursachen für diese Phänomene und entwickelt Handlungsempfehlungen, welche auf andere Branchen übertragbar sind.
