This work focuses on the issue of an ethical right to life. Its aim is to formulate a persuasive answer the question: What attribute can endow an entity with an ethical right to not have its existence terminated? In pursuing this objective, this work manifests three distinctive features. The first regards the delineation of the ethical enterprise. The second identifies self-consciousness as the attribute that endows an entity with an ethical right to life (this entity being the human entity, being that only the human entity possesses self-consciousness). Finally, the third feature lies in the kind of conclusion at which we can arrive, in the light of the foregoing two features, regarding the various issues implicating the termination of life such as abortion, euthanasia, suicide, assistant-suicide, and capital punishment. The issue of an ethical right to life is heavily politicized and divisive in Western societies. The reflections and analyses offered in An Ethical Right to Life contribute a much-needed clarification to the on-going discussion.

This groundbreaking book is the first collection to investigate the law, political science and ethical perspectives collectively in relation to the right and value of life. Its contributions from international roster of scholars are organized around five themes: a theoretical positioning of life and death; War, armed conflict and detention; Death as punishment; Medical parameters for ending life; and medical policies for the preservation of life. In studying this issue in its contemporary contexts of "right" and "value," the volume fills the current scholarly lacuna in the general subject of the orientations of life. It presents a much-needed examination of key issues in a broad practical and theoretical context, and holds broad appeal for scholars, researchers, and students occupied with issues of war, armed conflict, the death penalty, and various contemporary medico-legal scenarios.

Internationally renowned lawyer and philosopher Ronald Dworkin addresses the crucially related acts of abortion and euthanasia in a brilliantly original book that examines their meaning in a nation that prizes both life and individual liberty. From Roe v. Wade to the legal battle over the death of Nancy Cruzan, no issues have opened greater rifts in American society than those of abortion and euthanasia. At the heart of Life's Dominion is Dworkin's inquest into why abortion and euthanasia provoke such controversy. Do these acts violate some fundamental "right to life"? Or are the objections against them based on the belief that human life is sacred? Combining incisive moral reasoning and close readings of indicidual court decisions with a majestic interpretation of the U.S. Constitution itself, Dworkin gives us a work that is absolutely essential for anyone who cares about the legal status of human life.

The Law Of Life And Death written by Elizabeth Price Foley and has been published by Harvard University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-08-01 with Law categories.

Are you alive? What makes you so sure? Most people believe this question has a clear answer—that some law defines our status as living (or not) for all purposes. But they are dead wrong. In this pioneering study, Elizabeth Price Foley examines the many, and surprisingly ambiguous, legal definitions of what counts as human life and death. Foley reveals that “not being dead” is not necessarily the same as being alive, in the eyes of the law. People, pre-viable fetuses, and post-viable fetuses have different sets of legal rights, which explains the law's seemingly inconsistent approach to stem cell research, in vitro fertilization, frozen embryos, in utero embryos, contraception, abortion, homicide, and wrongful death. In a detailed analysis that is sure to be controversial, Foley shows how the need for more organ transplants and the need to conserve health care resources are exerting steady pressure to expand the legal definition of death. As a result, death is being declared faster than ever before. The "right to die," Foley worries, may be morphing slowly into an obligation to die. Foley’s balanced, accessible chapters explore the most contentious legal issues of our time—including cryogenics, feticide, abortion, physician-assisted suicide, brain death, vegetative and minimally conscious states, informed consent, and advance directives—across constitutional, contract, tort, property, and criminal law. Ultimately, she suggests, the inconsistencies and ambiguities in U.S. laws governing life and death may be culturally, and perhaps even psychologically, necessary for an enormous and diverse country like ours.

This publication contains 13 essays by various authors, looking at euthanasia from the point of view of ethics, and of religion (Buddhism, Catholicism, etc.).

Abstract: A comprehensive report by the US President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research addresses some of the most important and troubling ethical and legal questions in modern medicine for consideration by health care professionals, lawyers, and relatives of patients regarding the sensitive topic of voluntary cessation of life-sustaining therapy for the seriously ill. It was concluded that the cases that involve true ethical difficulties are much fewer than commonly believed and that the perception of difficulties primarily occurs because of misunderstandings about the dictates of law and ethics. It also is concluded that, while competent informed patients have the authority to decline or accept health care, others must act on the behalf of incompetent patients. The report urges that health care institutions develop and use internal review methods that permit exploration of all relevant issues. The 7 report chapters are grouped around 2 themes: the various aspects of making treatment decisions; and patient groups raising special concerns (e.g.: permanently-unconscious patients; seriously-ill newborns.
