From debt to divorce, from adultery to slander, cases with women as plaintiffs, defendants, or both appeared regularly on docket books in antebellum Illinois. Nearly one-fifth of Abraham Lincoln's cases involved women as litigants, and during the twenty-five years of his legal career thousands of women appeared in Illinois courts, as litigants, criminal defendants, witnesses, and spectators. Drawing on the rich resources of The Law Practice of Abraham Lincoln: Complete Documentary Edition, a DVD version of Lincoln's complete legal papers, In Tender Consideration scans the full range of family woes that antebellum Americans took to the law. Deserted wives, destitute widows, jilted brides with illegitimate children, and slandered women brought their cases before the courts, often receiving a surprising degree of sympathy and support. Through the stories of dozens of individuals who took legal action to obtain a divorce, contest a will, prosecute a rapist, or assert rights to family property, this volume illuminates the legal status of women and children in Illinois and their experiences with the law in action. Contributors document how the courts viewed children and how they responded to inheritance, custody, and other types of cases involving children or their interests. These cases also highlight Lincoln's life in law, placing him more clearly within the context of the legal culture in which he lived and raising intriguing questions about the influence of his legal life on his subsequent political one.

While the formal definition of divorce may be concise and straightforward (legal termination of a marital union, dissolving bonds of matrimony between parties), the effects are anything but, particularly when children are involved. Deeds, wills, divorce decrees, and other evidence of the public lives of nineteenth-century women belie the long-held beliefs of their public invisibility. Angela Boswell's Her Act and Deed: Women's Lives in a Rural Southern County, 1837-1873 follows the threads of Southern women's lives as they weave through the public records of one Texas county during the middle of the nineteenth century. Her unique approach to exploring women's roles in a South that spanned the frontier, antebellum, Civil War, and Reconstruction eras illuminates the truths of the feminine world of those periods, and her analysis of this set of complete public records for those years challenges the theory of men's and women's separate spheres of influence, as advanced by many scholars. The world Boswell reconstructs allows readers a more egalitarian, multicultural look at life: working class and poor women, both black and white, join their more affluent sisters in the pages of the Colorado County, Texas, courthouse records. Shedding new light on contemporary campaigns to encourage marriage among welfare recipients and to prosecute "deadbeat dads," Wives without Husbands traces the efforts of Progressive reformers to make "runaway husbands" support their families. Anna R. Igra investigates the interrelated histories of marriage and welfare policy in the early 1900s, revealing how reformers sought to make marriage the solution to women's and children's poverty. Igra taps a rich trove of case files from the National Desertion Bureau, a Jewish husband-location agency, and follows hundreds of deserted women through the welfare and legal systems of early twentieth-century New York City. She integrates a broad range of topics, including Americanization as a gendered process, breadwinning as a measure of manhood, the relationship between consumer culture and social policy formation, the class dimensions of family law, and the Jewish community as a source of welfare policy innovation. Igra analyzes the history of antidesertion reform from its emergence in social policy debates, through the establishment of domestic relations courts, to Depression relief programs.
