Excerpt from An Illustrated Treatise on the Law of Evidence To the trial lawyer no subject in the law curriculum is of more importance than Evidence. In this branch of the law questions arise very frequently, and usually they must be answered on the spur of the moment. It is essential, therefore, that the lawyer have at his tongue's end the rules and their exceptions. Moreover, since the test of the keen lawyer is his ability to make fine legal discriminations, it is also essential that he possess a well disciplined mind in the art of applying them. In the present volume an attempt has been made to state pointedly and systematically these various rules and exceptions; and since the law is an applied science, numerous illustrations have been given to elucidate their application. Every topic is fully illustrated; every illustration is founded upon an actual case, and for each case the citation is given. With the view of securing compactness, these illustrations, instead of being scattered throughout the book, have been made a distinct part of it and placed after the text proper. This plan, it is believed, will meet with general approval. As an aid in developing ability to make fine legal discriminations the reader is earnestly advised to study carefully these illustrations and where practicable to do so to read the cases upon which they depend. In the preparation of this volume it has been the aim of the author to produce a text-book which will prove serviceable when used independently of any other work; but believing that it will also be found serviceable in connection with the study of Thayer's "Cases on Evidence" the general arrangement of topics in that work has been followed. Excerpt from A Treatise on the Law of Evidence, Vol. 1 of 3 Omitting what is purely local law, and citing only such cases as seemed necessary to illustrate and support the text. Doubtless a happier selection of these might be made, and the work might have been much better exe outed by another hand; for now it is finished, I find it but an approximation towards what was originally desired. But in the hepe that it still may be found not useless, as the germ of a better treatise, it is submitted to the candor of a liberal profession. Excerpt from A Treatise on the Law of Evidence as Administered in England and Ireland, Vol. 2 of 3: With Illustrations From Scotch, Indian, American and Other Legal Systems 554. The first degree of evidence, and that which, though open to error and misconception, is obviously most satisfactory to the mind, is afforded by our own senses.l Believe half what you yourself see, and a twentieth part of what you hear from others, is a maxim, founded in the main upon the experience of life, marking the vast distinction that obtains between a knowledge of facts derived from actual perception, and the belief of the existence of facts resting on information. In judicial proceedings, the judge or jury can seldom act entirely upon evidence of this description.2 In a vast number of instances, however, especially where the fact in dispute is sought to be proved by circumstantial evidence, the verdict will rest materially upon matter submitted to the ocular inspection of the jury.
