This book examines secessionist entities that arose during and after the dissolution process of the USSR and considers them as legal subjects in their own right. By employing a novel and more innovative approach, the agency of these subjects, otherwise often ignored or disregarded, is taken into account. Drawing on the cases of the South Caucasus, the author suggests going beyond the binary concept of statehood and traditional notions of sovereignty. How do states prevent the recognition of territories that have unilaterally declared independence? At a time when the issue of secession is becoming increasingly significant on the world stage, this is the first book to consider this crucial question. Analysing the efforts of the governments of Serbia, Georgia, and Cyprus to prevent the international recognition of Kosovo, South Ossetia, Abkhazia, and northern Cyprus the work draws on in depth interviews with a number of leading policy makers to explain how each of the countries has designed, developed, and implemented its counter secession strategies. After explaining how the principle of the territorial integrity of states has tended to take precedence over the right of self-determination, it examines the range of ways countries facing a separatist threat can prevent recognition by other states and considers the increasingly important role played by international and regional organisations, especially the United Nations, in the recognition process. Additionally, it shows how forms of legitimisation or acknowledgement are also central elements of any counter-recognition process, and why steps to prevent secessionist entities from participating in major sporting and cultural bodies are given so much attention. Finally, it questions the effects of these counter recognition efforts on attempts to solve these territorial conflicts. Drawing on history, politics, and international law this book is the first and only comprehensive account of this increasingly important field of foreign policy.

A detailed history of a vitally important year in Alabama history The year 1865 is critically important to an accurate understanding of Alabama's present. In 1865 Alabama: From Civil War to Uncivil Peace Christopher Lyle McIlwain Sr. examines the end of the Civil War and the early days of Reconstruction in the state and details what he interprets as strategic failures of Alabama's political leadership. The actions, and inactions, of Alabamians during those twelve months caused many self-inflicted wounds that haunted them for the next century. McIlwain recounts a history of missed opportunities that had substantial and reverberating consequences. He focuses on four factors: the immediate and unconditional emancipation of the slaves, the destruction of Alabama's remaining industrial economy, significant broadening of northern support for suffrage rights for the freedmen, and an acute and lengthy postwar shortage of investment capital. Each element proves critically important in understanding how present-day Alabama was forged. Relevant events outside Alabama are woven into the narrative, including McIlwain's controversial argument regarding the effect of Lincoln's assassination. Most historians assume that Lincoln favored black suffrage and that he would have led the fight to impose that on the South. But he made it clear to his cabinet members that granting suffrage rights was a matter to be decided by the southern states, not the federal government. Thus, according to McIlwain, if Lincoln had lived, black suffrage would not have been the issue it became in Alabama. McIlwain provides a sifting analysis of what really happened in Alabama in 1865 and why it happened--debunking in the process the myth that Alabama's problems were unnecessarily brought on by the North. Despite popular belief, the Civil War did not end when Robert E. Lee surrendered to Ulysses S. Grant at Appomattox, Virginia, in April 1865. The Confederacy still had tens of thousands of soldiers under arms, in three main field armies and countless smaller commands scattered throughout the South. Although pressed by Union forces at varying degrees, all of the remaining Confederate armies were capable of continuing the war if they chose to do so. But they did not, even when their political leaders ordered them to continue the fight. Convinced that most civilians no longer wanted to continue the war, the senior Confederate military leadership, over the course of several weeks, surrendered their armies under different circumstances. Gen. Joseph Johnston surrendered his army in North Carolina only after contentious negotiations with Gen. William Tecumseh Sherman. Gen. Richard Taylor ended the fighting in Alabama in the face of two massive Union incursions into the state rather than try to consolidate with other Confederate armies. Personal rivalry also played a part in his practical considerations to surrender. Gen. Edmund Kirby Smith had the decision to surrender taken out of his hands—disastrous economic conditions in his Trans-Mississippi Department had eroded morale to such an extent that his soldiers demobilized themselves, leaving Kirby Smith a general without an army. The end of the Confederacy was a messy and complicated affair, a far cry from the tidy closure associated with the events at Appomattox.
