Die Sprache ist antiquiert, die Sätze sind kompliziert und die Begriffe abstrakt. Der Laie hat Schwierigkeiten das Gemeinte zu verstehen. Das BGB erhebt auch gar nicht den Anspruch, anschaulich und volkstümlich zu sein: es spricht nicht zum Bürger, sondern zum Juristen; es ist von Juristen für Juristen gemacht." (Bürgerliches Gesetzbuch 2002, S. XI). Die Sprache in Rechtstexten ist zwar Allgemeinsprache, weist aber Besonderheiten auf, die für den Laien zum erschwerten Verstehen beim Lesen - von beispielsweise Gesetzen - führen. Diese Hausarbeit soll sich mit der juristischen Sprache auseinandersetzen. Außerdem soll erklärt werden, in wieweit es sich bei der Rechtssprache um Texte der Fachsprache handelt. Es soll weiterhin darauf eingegangen werden, wie der professionelle Umgang mit Gesetzestexten durchgeführt wird und wie die Sprachwissenschaft der Rechtsprache gegenüber steht. Tagtäglich sind sie auf Übersetzungsdienstleistungen angewiesen, denn was dort besprochen und beschlossen wird, soll für alle Bürger der EU mit ihren unterschiedlichen Muttersprachen verständlich sein. Eine besonders große Rolle spielen dabei die Rechtstexte, die in fast alle Sprachen der EU übersetzt werden müssen. Dabei handelt es sich um die Übersetzung einer Fachsprache, die eine besonders große Sorgfalt und Genauigkeit erfordert. Ein wichtiger Bestandteil der Rechtssprache sind Phraseologismen, die sich von Sprache zu Sprache unterscheiden und für die zugleich eine treffende Übersetzung für den Erhalt ihrer Bedeutung unverzichtbar ist. In der romanischen Sprachwissenschaft wurde der Phraseologie erst recht spät Aufmerksamkeit gewidmet und wird bis heute im Rahmen der Fachsprachenforschung kaum beachtet. Die vorliegende Arbeit möchte daher die Wichtigkeit von Phraseologismen für die Übersetzung von Fachtexten, insbesondere Rechtstexten, anhand des praxisnahen Beispiels von Rechtstexten der EU verdeutlichen.

PATRICKNERHOT Since the two operations overlap each other so much, speaking about fact and interpretation in legal science separately would undoubtedly be highly artificial. To speak about fact in law already brings in the operation we call interpretation. EquaHy, to speak about interpretation is to deal with the method of identifying reality and therefore, in large part, to enter the area of the question of fact. By way of example, Bemard Jackson's text, which we have placed in section 11 of the first part of this volume, could no doubt just as weH have found a horne in section I. This work is aimed at analyzing this interpretation of the operation of identifying fact on the one hand and identifying the meaning of a text on the other. All philosophies of law recognize themselves in the analysis they propose for this interpretation, and we too shall seek in this volume to fumish a few elements of use for this analysis. We wish however to make it clear that our endeavour is addressed not only to legal philosophers: the nature of the interpretive act in legal science is a matter of interest to the legal practitioner too. He will find in these pages, we believe, elements that will serve hirn in rcflcction on his daily work.

This study concentrates on three major issues creating a basis for the making of the "Czech-English Law Dictionary with Explanations", namely language, including terminology, in both the Czech and Anglo-American systems of law; the process of legal translation; and the lexicographic method of producing a bilingual law dictionary. Terminology has been considered the most significant feature of language for legal purposes. It encompasses a wide range of special-purpose vocabulary and higher syntactic units, including legal jargon. Conceptual analysis is to be pursued whenever an identical term in the target language does not exist or its full equivalent is in doubt. Legal translation should be based primarily on comparative legal, linguistic and genre analysis in order to make the transfer of legal information as precise, accurate and comprehensible as possible. The primary objective of legal translation is for the target recipient to be provided as explicit, extensive and precise legal information in the target language as is contained in the source text, complemented (by the translator) with facts rendering the original information fully comprehensible in the different legal environment and culture. A dictionary which will help its users to produce legal texts in the target language should be founded upon a profound comparative legal and linguistic analysis that will (a) determine equivalents at the levels of vocabulary, syntax and genre, (b) select the appropriate lexicographic material to be included in the dictionary, and (c) create entries in a user-friendly manner.
