En las últimas décadas, la sociedad ha experimentado profundas transformaciones derivadas, entre otros fenómenos, del uso intensivo de las nuevas tecnologías en muy diversos ámbitos y de la masificación, la uniformidad y el anonimato de las relaciones de consumo. La incursión en el panorama jurídico de nuevas estructuras basadas en el colectivismo y la pérdida de protagonismo de la persona individual en la conducción de las relaciones del tráfico jurídico han desembocado en el reconocimiento de una enorme variedad de posiciones jurídicas de relevancia colectiva para las que el proceso tradicional se muestra insuficiente. En términos generales, la loable ampliación del acceso a la jurisdicción en un Estado social no ha venido acompañada por una articulación óptima y tempestiva de las herramientas procesales que puedan enfrentar estos nuevos desafíos. En esta obra se realiza un análisis de los instrumentos procesales diseñados para los casos en que el número de afectados por la lesión a un derecho fundamental es tan elevado que hace imposible o ineficiente la tramitación de solicitudes individuales de tutela con un procedimiento singular para cada una de ellas. Se examinarán los institutos procesales clásicos, que han demostrado su utilidad, pero también sus limitaciones para la defensa de la igualdad, el disfrute de un ambiente sano y la libertad sindical.
